Prosecution of a Lady. The following report, taken from The Standard, refers to a lady sometime resi- dent in Hongkong :—

for having on May 9, at Ixworth Abbey, Buffolk, feloniously or unlawfully forged or put off to George Berry, Harper, and Strouts, 140, Sloano-street, a certain me- morandum of agreement purporting to be an agreement for renting 24, Buckingham-

with intent thereby to defraud by signing the name of Captain Cecil Barrow, Simonds without his authority or power of attorney; also for feloniously forging or fraudulently uttering a certain telegram knowing it to be forged, addressed to Messrs Berry, Harper, and Strouts, and purporting to be sent by Messrs Barolay, tankers, Bury St. Ed- munds, contrary to the Toat Office Protec- tion Act 1884.'.

Mr L.W. Gregory, solicitor, supported the summons, and Mr V. B. Campbell. barrister, appeared for the defence. Mrs Simonds drove to the court in a cariluge.

Mr Gregory, in opening the case, said he would only at present proceed with the suinmona concerning the telegram. Section 11 of the Act mentioned in the summons- covered the alleged offence. The facts were that Messrs. Berry, Harper, and Strouts were instructed to let 24, Buckingham- gato, in March last, and advertised, thus getting into communication with Mes Simonds, who was the wife of Captain Simonds, of the Royal Artillery, and now in South Africa. She posed to the house agents as a person of means, with horses. carriages, and a coachman, and also as re- quiring stable-room in addition to the house. Sho anid she had a power of attorney, and an agreement was prepared between hor, and Mr Chapman, the landlord. One of the con- ditions was that the rent, £210 per annum, should be paid in advance. At the time of signing the agreement, Mrs Simonds gave: a.cheque for £210 upon Messrs Baro'ay and Co., Bury St. Edmunds, which was, how- ever, dishonoured on presentation for pay- ment. Again presented it was once more dishonoured. Inquiries were made by Messrs Parrs (Limited, the house agents baukers, Mrs. Simonds having given Cox and Co, as reference. The reference proved" unsatisfactory. Purrs refused to present the cheque a third time unless satisfied that it would be met. It was in consequence of this that he (Mr Gregory) would suggest that the fraudulent telegram was sent. A telo- gram having been sent to the lady, who was staying at Ixworth Abbey, after the secol presentation on May 14 of the che- que, she wrote, "I have just received your 2009 wire about dishonoured cheque. Kindly present choque again as soon as possible.- | Barclays gave me to understand that if I let them have my draft yosterday it could be cleared in time. That was untrue, and was part of the alleged fraud, in order that she might get possession of the house. Prosecutors wrote again to her asking for the rent in notes or money, \apon which they received a telegram, Some inistake notification bank this morning; draft one thousand paid to credit Saturday.'... That also was untrue. A request that some notification that the cheque would be mot having been again sent, & telegram arrived from Bury St. Edmunds, six milos from Ixworth Abbey, on 18th May, which was the subject of the present case. In the examination before Muster Lawford, the Defendant ad mitted that she practically paid not a penny, and that the whole thing was untrue. She bad no incore except from her father, her husband living on his pay. If the Magistrate was satisfied that the telegorams wore forged, he would asl for a committal for trials

Mr. Campbell said he would probably put a very different complexion on the case, and that the Magistrate would most likely then deal summarily with the matter, as there would not be a case to go before a Jury.

Evidence having been called in support of the summons dealt with, Mr Campbell cross-examined Mr Herper, a member of the prosecuting firm, and elicited that on the 3rd of June Mra Simonds called with a roll of notes and offered to settle up.' She said she had been put to some expense over

Mr Campbell, in addressing the Magis- trate for the defence, said that there was not the slightest foundation for the prosecution to assert that the Defendant misrepresented her position, or that sher had any intention to defraud. Her mother was an independent lady, and her father, Mr William Easton, of Broadway, New York, a wealthy man connected with Tattersall's and a successful horse breeder. After the action brought fighting against her, and when she was with her back against the wall,' it were, it seemed that her conduct was in the circumstances not unreasonablo. Shortly before the transactions in connec. tion with the house £835 was paid into her account, and £1000 was sent for her and her sistor. Defendant took her slate of that, amounting to £430, but being unfor- tunately addicted to putting money on horses, lost most of it at the Spring meet- inga by backing a dead cart." The money a difliculty, and being lost, she was in cabled to her father for more, as he owed her £1000, but he did not get the cable, as he was yachting off the coast of-Bermuda, She then cabled to his solicitors, Murray and Hodge of New York, and it was therefore perfectly true that she was ex- pecting £1000 from day to day, and felt in the position to write out the cheque." That, as a fact, was the condition of affairs op till May 9, when the agreement was signed. Counsel ventured to think that this prosecution, taken four months too Tate, might now ond by the Magistrate adjudicating upon it without the necessity of calling a great deal of evidence for the defence, which would be necessary if the case went on.. It was true that she must confess to having, in the course of transac- tions, made a statement that was nut absolutely correct, but she was ill, and still anxious to have the house, and her mind was not in the same condition as if she had been in perfect health.

DIAMOND HOBBERY,

Chu Cheung was charged with stealing seven diamonds valued at $55, the property of his muster Ng Fuk on September 14, 1903.

The Attorney-General prosecuted and the accused pleaded not guilty.

The accused said that Wong I Lam took away the diamonds, and that he went to Canton to look for him but without success. On failing to find Wong I Lam in Cauton, explain he returned to Hongkong to matters.

His Lordship then addressed the jury, who without retiring, brought in a verdict of guilty, The Attorney General pointed out that the accused was the man, whom the previous prisoner said gave him the diamond to pawn, which he thought was very likely.

His Lordship passed a sentence of eight- teen months' hard labour, and suggested the propriety of having the prisoner de. ported at the end of that time, he being an undesirable person to have in the colony.

RETURNING FROM BANISHMENT. Ngau Fuk was charged with disobeying an order for banishment, which was issued on September 21, last.

The Attorney General prosecuted. The accused admitted being banished and said that he went to Canton, where he remained one month, and on the advice of a friend he returned to Hongkong.

The Attorney General pointed out that this was the third time the accused had returned from banishment and asked for the maximum penalty. His Lordship Passed a sentence of twelve months' impri sonment with hard labour, and ordered him to be deported at the expiration of his sentence.

STEALING.

Cheung Kau and Woo Ku were charged with breaking into the dwelling-house of Lo Tsoi, at No. 10 High Street, and stealing one box containing clothing, ono blanket and one water smoking pipe valued in all at $487.

The Attorney General prosecuted. The first accused said that he went to borrow money from his friend, but as he was out he took the goods away and asked was that larceny; on being informed that the taking of the goods constituted larceny, he pleaded guilty, and asked that His Lordship would not deal severely with him, as he only wanted to get a few dollars" to go home.
