PUBLIC AUCTION,

INTERESTING INSURANCE

CASE.

In the Court of Appeal somo inʊnths ago, before the Master of the Rolls and. Lords Justices Romer and Mathew, the following interesting insurance else was decided :-

Stuart . Freeman-This was an appeal by the Plaintiff asking for judgment or a new trial. in an action which was hoard before Mr Justice Ridley and a Special Jury in April last, when judgment was given for the Defendant, who was the Managor of the General Life Assurante Company.

Mr Eldon Bankes, K.C., and Mr Arthur Powell, K.C., appeared for the plaintiff's Mr Duke, K.C., and Mr Ellis Hill for the Defondant.

THE Undersigned will Let by Public by reason of the arrear of payment, had

the 19th January, 1903, at 3 p.m., on the spot,

Mr Stuart, by whom the action was brought, was the assignee of a policy of in- surance effected upon the life of the Hon. Francis Charles Lawley for £2500, granted

in November, 1899. By the terms of the by the General Life Assurance Company policy the premiums were payable quar- terly, and in the event of any premium being in arrear more than 30 days the policy was to become void. On Septem- hor 17, 1991, the quarter's premium due on August 18 had been in rear 39 days. On September 18 the Plaintiff paid, the Defendant gass 7& receipt

the for

then overdue. premium At the time of the payment the Hon. F. C. Lawley had died-namely, at two o'clock on September 18, though the fact of his death was unknown to both the Plaintiff and the Defendant. The Defend. fint rofused to pay substantially on the ground that the acceptance and re- ceipt of the premium for the insurance of the life of versin who was then dend could not possibly extend the policy which,

temporarily lapsed. At the trial the Plaintiff pleaded that in fact the policy had nat lapsed or become void. It was a policy for a year, the premium for each Buch period being payable in four equal instalments for convenience only, and, therefore, the acceptance of the instalment of premium, though overdue when paid, by an agent of the Company, precluded the Defendant from pleading any such defence. Evidence was also given that on a former Occasion, when the premium was paid day late a clerk to the Company had in formed the Plaintif, after he had inquired from the manager if he might take the premium that the premiums would be accepted if paid a day or s after the 22 days of race had expired. The learned Judge only left to the Jury the question whether the conversation alleged by the Plaintiff to have taken place between his clerk and the clerk to the Insurance Com- pany had; in fact, taken place, and they answered that in favour of the Plaintiff. The learned Judge, however, entered judg ment for the Defendant, holding, as a mat. ter of law, that there was no liability on the Company to pay upon the policy, which, hy reason of the condition as to payment of the premiums within 30 days of their he coming due, bad become void. From that judgment the Plaintiff appealed, and there was a cross appeal by the Defendant on the finding of the Jury.

The Several Lots Numbored 1 to 19 on Plan to be seen at the Auctioncris' Office, for erection of BOOTHS and MATSHEDS on the Government Ground adjoining the Racecourse, North of the Grand Stand Enclosure.

had these questione been left to the Jury to return an answer on. It seemed to him that there was ample evidence to go to the Jury où the question of the authority of the clerk to accept the premium on the 31st day, as there had clearly been an arrangement between the parties that tho days of grace should be extended one day. Therefore it must be taken as if the premium had been a payment made within. the 30 days of grace, and that the fury. ODOWNS at WANCHAI, with Pier would have found. On that finding a whother payment within the 3 days of grace, al- though made, in fact, after the death of the assured, was in law a good payment when the death of the assured was un- known to either party. In considering that point it was necessary to consider whether the payment was one of a series on a policy current, or was a paymens to renew or reviva a policy that had lapsed. Here the policy on the assumed finding of the Jury was current, and, moreover, the payment aquarterly payment of a policy effected for a year. which period had not expired. These being the admitted facts, it was not necessary to consider if the same considerations would apply in the event of the premium not being the fourth premium on a policy that was cur rent. The conclusion the Court had come 2193 to was that this payment was a valid pay-

ment on a policy that hail not lapsed, and therefore the Plaintiff was entitled to re- cover the sum named in the policy.

THIS BAD OLD WORLD.

There's plenty of good in this bad old

world,

In spite of what cynics say.

There's many a band held out to help

Another on his way.

The world is selfish, the world is cold,

And its idol is success ;

Yet it often steps aside for fear

On the fallen it will press.

There's many a hero gives up his life

In humble duty dono,

With no hope of glory to shrine his name

Past the setting of the sun.

Dearly the world loves dollars, and yet,

In spite of its grasp and greed,

There's many a dollar freely spent

On the widow and orphan's need.

Bad as it is, with its vice and sin,

This old worn world of ours,

It bends with awe before pure things,

And love and faith are powers,

It may fellow the winner with homage and

cheers,

Though his right lies in a fog:

But there are plenty in it who'll boldly still

Stand up for the under dog.

W. D. Nesbit, in Baltimore American.

DON'T WAIT.

The world will find worth out, they say,

And don't you sit and wait, my boy i The say each dog will have his day,

But don't you sit and wait, my boy, Some day when you are old and gray The world may think 'tis time to lay Rewards upon your plate-it may

But don't you sit and wait, my boy.

The world's intentions may be kind,

But don't you sit and wait, my boy, For worth that waits is hard to find,

So don't you sit and wait, my boy; The world may turn, some day, inclined

To cheer the worth that lage behind,

That through long years has hoped and

pined

But don't you sit and wait, my boy. -S. E. Kiser, in Chicago Record-Her d.

JUDGE SLOWLY.

It is not always an easy matter to judge correctly of the quality of things. Less than one in a thousand of as is capable of accurately estimating the worth of a picture; not more than one in o-hundred the quality of a horse. In general, judgments rapidly made are of small valuo Did you ever notice,' recently inquired a visitor to an English University town of his companion, as they sat together on a verandah, that queer-looking old fellow with the idiotic face turned-up coat collar, and boots seven sizes too large, who passes hore every morning at ⚫leven? Many a time,' replied the other, Ho is Professor of Comparatire Grammar to the University of, and speaks fourteen modern languages, to say nothing of his mastery The incident of Greek, Latin, and Hebrew." will serve to show the futility of superflcial judg

ent. Many judgments which pas unchall- enged aro none the less deplorably wrong, more especially in matters which require a practical test. Who can say positively whether a certain medicine has the power to cure scane partienfor

lady or not without giving it a trial?

When the friend of Mr Michael Fitzpatrick, of 60, Forbes Street, Woolloomooler, Sydney, N.S.W., advised him to take Mother Seigs i's Curative Syrup for the cure of indigestion. he backed his advice with Some excellent reaSOTIS ---- excellent because it's judgment of that uredy was based upon actual experience of its merit. Suys Mr Fitzpatrick in a letter written on the 20th June, 1902: For many years I suffered terribly from indigestion and Liliousness, aut spent pounds on doctors' medicines and so-called eures; but without avail. In those days I had o appetite, and the little food I ate turned sour on my stomach, causing severe attacks of I was also troubled with pains in heartburn. the chest, violent headaches, and habitual cou- stipation. In fact, at one time or other 1 suffer from mast of the symptoms which characterise u sluggish ver and impaired digestion. My worst afiliction, however, was a total inability to obtain sufficient sleep.. I would go to bed feeling worn-out and sleeps, hut as soon as my head touched the pillow my brain would become uzinaturally active, nodi would think of every kind of subject, and roll and toss about between the sheets, listening to the Fish Market Clock as it chimed hour after hour, until all my nurves were in a quiver. - Then I would rise and walk the floor, backwards and forwards, the greater portion of the ght. For years I had been in this wretched slate when one day a fri sud fortunately called to sue i me. I was trying the hot water cure at the time, aud was just in the act of drinking a enpful of steaming liquid. He asked me what I was: taking it for. I described my troubles to him. and in reply to a further question Informed him that I had not, so far, gained any relief from the hot-water treatment. Ho advised me to abandon it and try Mother Seigel's Curative Syrup instead. He gave me such excellent reasons for doing so that I accepted his advice- advice which, I am thankful to say, has had thei very best results. After taking only one spiall bottle I felt very much better. As1 coutinued to take the Syrup, so did I continue to improve in health, and in less than two months my care was accomplished. That was three years ago, and I have remained in good health ever since, which proves conclusively that it is not mere passing relief that Mother Seigel's Curative Syrup affords to sufferers from indigestion, but Now I am careful naver to be permanent cure, without a bottle of the Syrup on hand, as I take a dose occasionally to counteract the ill effects of my sedentary occupation-for I am a boot. maker by trade and for this purpose I find it acte like a charm.'
