Stuart . Freeman-This was an appeal by the Plaintiff asking for judgment or a new trial. in an action which was hoard before Mr Justice Ridley and a Special Jury in April last, when judgment was given for the Defendant, who was the Managor of the General Life Assurante Company.

Mr Stuart, by whom the action was brought, was the assignee of a policy of in- surance effected upon the life of the Hon. Francis Charles Lawley for £2500, granted
in November, 1899. By the terms of the by the General Life Assurance Company policy the premiums were payable quar- terly, and in the event of any premium being in arrear more than 30 days the policy was to become void. On Septem- hor 17, 1991, the quarter's premium due on August 18 had been in rear 39 days. On September 18 the Plaintiff paid, the Defendant gass 7& receipt

Lawley had died-namely, at two o'clock on September 18, though the fact of his death was unknown to both the Plaintiff and the Defendant. The Defend. fint rofused to pay substantially on the ground that the acceptance and re- ceipt of the premium for the insurance of the life of versin who was then dend could not possibly extend the policy which,
temporarily lapsed. At the trial the Plaintiff pleaded that in fact the policy had nat lapsed or become void. It was a policy for a year, the premium for each Buch period being payable in four equal instalments for convenience only, and, therefore, the acceptance of the instalment of premium, though overdue when paid, by an agent of the Company, precluded the Defendant from pleading any such defence. Evidence was also given that on a former Occasion, when the premium was paid day late a clerk to the Company had in formed the Plaintif, after he had inquired from the manager if he might take the premium that the premiums would be accepted if paid a day or s after the 22 days of race had expired. The learned Judge only left to the Jury the question whether the conversation alleged by the Plaintiff to have taken place between his clerk and the clerk to the Insurance Com- pany had; in fact, taken place, and they answered that in favour of the Plaintiff. The learned Judge, however, entered judg ment for the Defendant, holding, as a mat. ter of law, that there was no liability on the Company to pay upon the policy, which, hy reason of the condition as to payment of the premiums within 30 days of their he coming due, bad become void. From that judgment the Plaintiff appealed, and there was a cross appeal by the Defendant on the finding of the Jury.

had these questione been left to the Jury to return an answer on. It seemed to him that there was ample evidence to go to the Jury où the question of the authority of the clerk to accept the premium on the 31st day, as there had clearly been an arrangement between the parties that tho days of grace should be extended one day. Therefore it must be taken as if the premium had been a payment made within. the 30 days of grace, and that the fury. ODOWNS at WANCHAI, with Pier would have found. On that finding a whother payment within the 3 days of grace, al- though made, in fact, after the death of the assured, was in law a good payment when the death of the assured was un- known to either party. In considering that point it was necessary to consider whether the payment was one of a series on a policy current, or was a paymens to renew or reviva a policy that had lapsed. Here the policy on the assumed finding of the Jury was current, and, moreover, the payment aquarterly payment of a policy effected for a year. which period had not expired. These being the admitted facts, it was not necessary to consider if the same considerations would apply in the event of the premium not being the fourth premium on a policy that was cur rent. The conclusion the Court had come 2193 to was that this payment was a valid pay-
ment on a policy that hail not lapsed, and therefore the Plaintiff was entitled to re- cover the sum named in the policy.

For years I had been in this wretched slate when one day a fri sud fortunately called to sue i me. I was trying the hot water cure at the time, aud was just in the act of drinking a enpful of steaming liquid. He asked me what I was: taking it for. I described my troubles to him. and in reply to a further question Informed him that I had not, so far, gained any relief from the hot-water treatment. Ho advised me to abandon it and try Mother Seigel's Curative Syrup instead. He gave me such excellent reasons for doing so that I accepted his advice- advice which, I am thankful to say, has had thei very best results. After taking only one spiall bottle I felt very much better. As1 coutinued to take the Syrup, so did I continue to improve in health, and in less than two months my care was accomplished. That was three years ago, and I have remained in good health ever since, which proves conclusively that it is not mere passing relief that Mother Seigel's Curative Syrup affords to sufferers from indigestion, but Now I am careful naver to be permanent cure, without a bottle of the Syrup on hand, as I take a dose occasionally to counteract the ill effects of my sedentary occupation-for I am a boot. maker by trade and for this purpose I find it acte like a charm.'

This sum the Chinese Ministry of Foreign Affairs has ordered the province of Kiangsu to pay, one-half, or Tle, 140,000 to be paid from the treasury of Lower Kiangsu by the Provincial Treasurer at Souchow, and the other half to be paid by the Provincial Treasurer of North Kiangsu (Kiangning or Nanking), and it is stated that the money will be paid in a few days from date.
