He stated that it was more- ly a test cas, and after giving evidence ar to the slipping of the trait allowed the care to go without argument. was abwitted by the solicitor for the do- fence that the particular kinds of fruit in question, namely duriane and mata richinge, boing of a perishable nature, caine within the saving clause. The Court, taking the same view, dismissed the cuss, declining to make any dis tinction between different kinds of fruit 43 to their differcat degrees of perishableness, thereby holding, we take it, that cargues of fruit of any kind may be suipped or discharged on Sunday without let or hindrance. Now, whether. this devision is strictly in accordance with the letter of the law or not, it is certaialy autagonistic to the spirit of it. But we question very much whether it can be justified on a purely literal in- terpretation of the saving chase, unless reference to the general tenor and it is taken absolutely alone and without intent of the ordinance. The exclusion of mails, personal luggage, live stock, ice or articles of food of a perishable nature from the definition of cargo is obviously intended as a separation of these particular things from the general freight of the ship and not as an ex- emption extending to the whole cargo. When this ordinance was being dis- cassari, we suggested, that there were certain points in regard to which it would be well to follow the Hongkong crdinance more closely than it was at first proposed to do. The wording of the saving clause referred to is one Tasa.
