would never be attempted in England; and it is equally clear that no one poru sessing an accurate estimate of his res ponsibilities as Grand Jury and Counsel for the Crown, would ever bave dreamt of doing a thing so outrageously ill- advised and so liable to misconception, especially by an Asiatic population. The system under which a Counsel for the Crown is enabled to add to his in- come by privato practice is one which sometimes is apt to exhibit developments of a sufficiently delicate nature without overstepping the clear line which "divi des public duty from personal interest. In the case of Region versus Goh Sin Tee, the Attorney General raust, 06 Grand Jury, have filed a true bill against. the prisoner, and yet, although he public ly stated that he would have entered a nolle prosegui had the prosecution been conducted by himself, he deliberately. accepted a fee from the defence. This action Mr Bonser endeavours to justify on the ground that he feels himself bound to conduct the prosecution of such cases sent to the Assizes in, which the Police prosecute; but when casos are taken up by Couusel engaged by parties interestest, he assumes that he is then nt liberty to change to the other side and accept a fes from the prisoner. It is possible tint in Hongkong we are a long way behind the times; but snch reasoning is the most extraordinary justification of irregular conduct on the part of a Legal Adviser of the Crown that we ever met with. As a Grand. Jury, the Attorney General is paid for arriving at a decision as to whether or not there is a case for the patty Jury. He is likewise paid for deciding, aftor aking himself more fully acquainted with the facte, whether or not a nolis prosequi should be entered. These are his duties, s for echo analogy of this Colony holds good, and Mr Bonser (the Attorney General of the Straits) then calmly goes into Court, Recepts a fee from the prisoner, and at the same mo meat informs the Court that he is en- abled to do so only because the Attorney General (the self-sane Mc Donser) as.. not done his duty and entered analle prosequi! It may occasionally be a difficult matter for the Grand Jury to.... decide whether or not a true bill should" At one time it was thought that Hong-be filed in any particular case, but it. kong was to be far ahead of the Straits would be more than a doubtful advant- in the matter of defences. The tables age to simplify such difficulties by at- seem now to be tacneil, and the Sin-tucbing a private foo for the Attorney aporeans bid fair soon to leave Doug General in every defence.. And yet, if Kong far behind. The Acting Governor we grant the principle to be right, such of the Straits (Hon. G. C. Smith) has might become the usual procedure. So lutely thrown an amount of zeal and far as the caso against Goh Sin Tee is independens action into public affairs explained, Mr Bonser (the Attorney, which must be refreshing to the Straita General) was simply trying Colunists. What may be regarded as a what had been done by the Attorney now departure in the administration of General (the same Mr Bonser). This Crown Colonies took place quite recent is the ridiculous side of the situation. ly, when the Whipping Bill (abolishing What estimate the natives will, form Hogging in certain cases) was thrown of British Justice as exemplified ja such out by nearly every official and anofi- conduct is a far more serious thing than cial member of the Conneil, even the Mr.Bonser may faney it to be. It is so. Acting Governor himself expressing his serious, indeed, that we would rather sympathy with the opposing force, met give it a definite description. Man's though voting against it.
