whishover way the decision was given. Mr Humphreys was very desirous that defendant should not be loft destitute in the Colony, and the learned counsel said the defendant would do as much now as he would have done had no action been taken, Mr Dennys said that particulars lind not been supplied, but had been refused him. He had heard nothing of the prescription formerly, and the only thing he knew of misconduct was getting brandy and refusing to pay for it. He (Mr Dennys) believed that it required a good deal of manual labour to make up a pill, although people appeared to think it was an easy matters Nothing was said about the prescription before; but Mr Dennys contended that, if the Court believed his client's statement, he would eco that, as Mr Daggleby was ill, he did the best thing with the prescription, viz,, re- turned it, so that it could have been ut unou mado up elsewhere. Thomas Hetherington, an assistant in the firm, deposed that onch the assistants had stated hours to attend to business. Mr Humphreys (the defendant) had the manage ment of the meas now, formerly one of the assistants had charge of it. Supposing the moss required anything, such as wine, beer; or spirits, the Moss President would send a ohit to the store-room for it. Should brandy be required for private use, it would be ordered in the same way and would be entered in the cash sales book, and, if paid for or if not paid for, would be put in a book debited to the person for whom it was ordered. Witness was present one day brandy on mess nights. The plaintiff' hed ticket of leave, be joined' with Peisley and bloodthirsty bushranger ever known in chase of the nearest of the three. But he applied to these regulars from when Mr Humphreys went into Mr Dug- gleby's room and complained of the way in which spirits had been obtained from the store-room. The stora-boy would state that the plaintiff had had 20 bottles, whereas the plaintiff would state seven or eight bottles, and these had been entered as oigars. Mr Humphreys had only found 2 or 3 satries of cigare, and plaintiff had asserted that the spirits had been put down as sundries, and that he had paid for them.
Mr Duggleby admitted that the last bottle of brandy he had was not entered, but said that he had told the Chinaman to go down and make the entry.
Witness stated that he had never known plaintiff to be the worse for liquor. Per haps he had known him elevated when off duty, but never fuddled. Did not recollect that plaintiff was unfit to dispense medicine on the 15th December. Witness know that
he do nawell.
Witness then explained the manner in which prescriptions were dispensed. The prescription, he said, would be entered in the prescription book.
The prescription book was produced and examined, and an entry referring to the plaintiff having been referred to, a pro- Boription was compared with the copy in the book.
