the voyage. Defendant alleged that these goods were carried on deck at shippers risk." He stated that when the reasol left London she had on deck seventeen cases more or less of like goods, that one of these cases was die. covered, when off the "Nore," to be leaking and had to be thrown overboard, During the 17th and 18th of June, the vessel encountered strong gales, with. heavy seas, large quantities of water coming on board, smashing everything moveable, causing a leakage among the cases, the liquid from them burning the decks and the feet of the crew. On morning of the 17th, for these reasons, it was necessary to heave overboard all the cases which were on one side of the deck, and, on the following morning before daylight, all of the remainder upon the other side, which was not accom- plished without much difficulty owing to the danger of the task. By express terms of bill of lading, as well as com- mon custom, the Master was, defendant pleaded, not responsible for loss of any such deck cargo,

The three cases of collodion were re ferred to in the Bill of Lading, which was in the usual form, as follows —–—–— "Seventy-one packages merchandise, in- oluding three cases of collodion on deck at shipper's risk, being marked and num bered as per margin, and to be delivered, subject to the exceptions and conditione hereinafter mentioned, in the like good order and condition from the chip's tackles Defendent relied on the fol- lowing exceptions in the document 1. “ "Jettison

and all and every the dangers and accidents of the seas, rivers, and canal, and of navigation of whatever nature or kind," and "the ship is not liable for leakage or breakage There was, defendant pleaded, (1) an express stipulation in the contract that the goods were to be carried at plaintiff's risk's (2) that there was a custom that for goods suob as those in question the Master: should not be responsible in any event ¡ (6) and that the goods were jettisoned, and jettison was expressly excepted in the Bill of Lading,

Upon the first and second of these points, Mr Wilkinson said

As to the first point, it has been argued by Mr Willie that the words "on deck at shippers' risk” relieve the master from sli responsibility whatever. I have looked in vain for any case in which the expression "'on deck at shippero' risk" has been the subject of decision. There are c however, turning upon expressions somewhat

them so far as they go, and to apply to the present case the principles to be extracted from them.
