was not in a fit state to instruct counsel. The prisoner had told the doctor that he was in gaol because some people accused him of doing something, he did not know what. Be tented having killed his wife, The doctor further said it would be difficult to judge of the prisoner's sanity or Insanity without further observation,

Mr Ng Aghoy then commented on the evidence at some length, and said he thought the Jury would be satisfied after what they had heard especially from the medical mea, that the prisoner was not in his right mind,

The Attorney General briefly addrossed the jury, and said the doctors both ap peared to have placed great weight on the prisoner's appearance, which they said was the same as at present. The jury would doubtless be able to judge as well as the doctors. According to Russell on Crimes, if the prisoner was not capable of ander standing the nature of the proceedings in a Court of Justice, he should be confined during Her Majesty's pleasure. The jury, he continued, were the judges as to the prisoner's state of mind; the doctors might of course be mistaken. They could judge to some extent by the pri- souer's appearance.

His Lordship then summed up the evid- ence. He reminded the jury that there was such a thing as shamming maduess, and in that cass the prisoner would, if our ning, put on a certain demeanour deceive the jury.

The Jury found that the prisoner was not able to plead, being of unsound mind. Prisoner was therefore ordered to be confined during the pleasure of His Excel- Icacy the Governor.
