Mr Watts, au overseer of works attached to the Surveyor General's Department, stated that on the 4th instant, Mr Bowden wrote to the Survey Depart ment to ask permission to open a drain in Ladder Street, The complainant received the letter on the evening of the 4th from Mr Bowdler, the Assistant Surveyor Gene ral, but as there was no numbor given of the house in the letter of the complainant could not trace the house out. On the 5th he told Mr Bowdler that he could not find the locality... He saw, however, the con- tractor who was engaged to do the work, and he was to meet Mr Watis at 7.30 am. on the 6th for the purpose of shewing him the work, to see whether permission could be given for its execution. There was no contractor to be found at the time and place appointed, and instead theroof Mr Watta found's large trench out in the road. A report was then made to the Surveyor General, who directed a summons to be taken out, as the place was dangerous to the public-The defendant stated that he gave instructions to his contractor to repair the drain, and on the 4th he gave him a loser to the Surveyor General to have the permission. On the 7th he learnt from the rent collector that the work had not been.
