SUPREME COURT. IN SUMMARY JURISDICTION, (Before Als Hon. Mr Justice SnowDEN).
THE GHINA MAIL.
Chow Sing v. C. L. Thevenin, $52.-The claim was for a set of bozes supplied to the defendant. The defendant admitted $35. The plaintiff and the defendant's adinis slon was correct, as it was owing to a mis take of his that the amount paid on account was not credited in his books.
defendant answers "Tell him to keep his quite clear in his Lordship's mind that the mind easy." What can this mean but that plaintiff had been paid his wages both for something had been sold by the defendant June and July, and as to the lie he told in to the plaintiff of which delivery was to be regard to the beating, his Lordship would given. Notwithstanding the defendant send him to prison for a short time on this Bays on being referred to a letter of his in occasion as a warning to him, and he hoped which conditions are mentioned, "I meant he would not come again to this Court and by conditions that I was to give delivery make false statements. The plaintiff was orders and he was to give me my balance sent to seven days' imprisonment in addi- and I was to be free." I was not astonished tion to a judgment being entered agafast to find that the defendant could not men- him. tlon a single other instance of such a one- sided bargain. It is scarcely possible that as the defendant made the plaintiff his broker to clear the transaction between himself as vendee and the holder, with directions to hand the balance to the defendant, that he can have been lot into such a misunderstanding. I must batore, again, as I have often done express my opinion that the custom in Hongkong of conducting sales of the goods through the medium of a broker without bought and sold notes passing is a most objectionable one. I must also regret that Mr Wat Akwong was not made the plaintiff Thore la ample evidence to show that he was the principal even in the absence of bought and sokt notes. Many difficulties would have been avoided. The only ques- tion remaining in that of damages. The measure of damages on a breach of contract for the delivery of goods is the difference between the contract price and the market price on the day fixed for delivery. It is proved that the 31st was the day red. There is a difference between the plaintiff and defendant as to what the market price was on the 31st; one says it was $83, the other $88. This zaust be ascertained. Mr Johnson says that it was $89 on the S1st July.
Judgment for plaintiff, for the price of quicksilver between the contract price and the price on the day when delivery should have been made.
The Hongkong Rice Company Limited v. Lee Toong, $122.79.-This was a claim for rice supplied to the defendant, who did not appear to contest the claim. Judgment for the plaintiff, for whom Mr. Brereton appeared.
The defendant said he had offered several times to pay the amount, but the plaintiff would not accept it. He was even sent for twice yesterday, but would not come. Judgment for the plaintif for $35, without costs, his Lordship presuming that Mr. Thevonin would not claim compensation for his attendance here to-day.
Chun Amo, alias Cheap Jack v. Wm. Bower, $5.75; a. Spencer, $10.25; v. Don- nelly, $9.00; v. John Bower, $14.05; v. David Scott, $3.75.
The plaintiff in these cases is a tallor carrying on business as Chesp Jack, and the defendants are members of the orew of the British ship Twilight, and the olala were all for clothes supplied.
In the case of Wm, Bower, cook on board, the defendant admitted $5.50, but it ap. peared from the plaintiff's book there was an entry in the defendouts hand-writing for $5.75. Judgment for $5.75.
In the cass of Spencer, the debt was admitted, and judgment was accordingly given in favour of the plalatiff.
In the case of Donnelly, the defendant admitted $3.50, the other 10 cents being for value of a handkerchief which the plaintiff gave to him as a "cumshaw."
The plaintiff said he agreed to give the handkerchief in case he was paid his money, thought he had a right to charge for it. but as the Captain had refused to pay, he His Lordehip held that, as the plaintiff had no doubt intended the handkerchief to be a present, the 10 cents sharged would In the case of John Bower, steward on board the Twight, he admitted only $12.90. The two linen collars should not be charged for, as he ordered him to make two shirts with loose collars, and when they were brought on board, he found the collars sewn on, so he told the plaintiff to take them away and to remove the collars. He took them off and brought two loose collars for which he now charged. He was also charged for a pair of braces, but they were given him as a gift by the plaintiff, present of the braces to the defendant if he could get the Captain to pay him his money..

His Lordship said he was glad to hear it, and finally gave judgment for $12.90, the defendant to return the braces to the plain tiff, as he did not want to keep them, be- cause he never wore braces with brass buckles or leather straps.
