Amico Giacomo, an Italian, and Joseph Fachor, au Austrian, were indicted on two counts of homicide, one charging them with wifal murder, and the other with man- slaughter, in the death of a Chilian named Manoel Rae, on the 14th June lask.
The prisoners pleaded not guilty. Mr J. J. Francis, instructed by Mr L. Dennys, defended the prisoners, and

The following Special Jury was empanel-a led: Messrs D. Gillies, A. T. Manger, H. Hoppius, J. A. dos Remedios, E., Bas Boon, H. C. Erdmann and C. E, Thompson. Captain D. Moss was sworn in as later preter for the prisoners in two dialects of Italian).
The Attorney General said the prisoners, as the Jury had heard, were indicted on two counts for murder and manslaughter. It was quite competont to them to return a verdiet of manslaughter if they should find that the prisoners were not guilty of the more serious grime of murder, even if there was only one indictment for murder alone, Bar the fast that the two counts were put in was for the purpose of bringing it more before their mind. With regard to the evidence the witnesses were mostly Buss peans, and there was some difficulty to getting interpreters; but in the prosent case, this difficulty had been obviated. He asked the Jury to dismiss from their minds what they had heard in connection with this matter and to confine themsolves to the evidence that would be brought before them, alone, devoting their undivided attention to the вате. The facts as elicited from the depositions were, It appeared, that the deceased was lodging in a boarding house kept by a man named Beltrao, having been discharged from a ship, while the prisoners, discharged from the Jan D. Peters, lodged in the same house also. The Attorney General then proceeded to narrate the facts, which were the same as those we published from the evidence given before the Corner.
