from the house, The point for consider- ation really is whether the plaintiff had a right to permit a dog, which he did not know was ferocious, and which hus hot been proved to be so, to be at large on his premises at night for the purpose of guarding them. There is no law that we are aware of which says that this shall not be done; nor would the appli jy1gation of such a law be advisable in an out-of-the-way place like Kowloon. See ing then, that the dog was shot for per- forming a legitimate duty the justice of his Lordship's judgment is apparent. As to the assertion that the dog was shot by accident we attach little importance to that. Granting that revolvers may some times go off of themselves, it is somewhat singular that the defendant's should have done so at this particular moment and have been pointed at the dog. Probably the fact of the matter was that he fired it in the direction of the dog, not much caring whether he hit it or not; however, as his shot did happen to be a successful one, be should clearly take the responsi jytility of it.

Although, however, the judgment of the learned Judge is satisfactory, wO CAN. not say as much of the law he laid down in the course of it.
