We are willing to grant a good deal in favour of the Chinese merchant. He is now as a rule, and, we may add, was ut one time invariably, strictly punctual and honest in the performance of his b sinca responsibilities, and his word is in the majority of cases "as good as his bond." He is sober, not by any means nintelligent, is a quiet and order-loving man generally, and is usually an exem- plary citizen, cámáng but little trouble to the Government under which he resides. Of course, we speak of the "merchant," and so long as we conne ourselves to this clues we can easily find more to praise than to censure. How then comes it that with these admitted good qualities, any legislature profes sedly enlightened--and California is not by any means behind the age--can be found to intentionally keep him in a position which without enslaving him a slave's position? conscience of a Chinese analogous to the process which we describe as "putting a man on his oath." And be it noted that amongst the lower classes of nominally Christian or Mahomedan countries, the depth of degradation into which any individual bas aank is no infallible test of his indifference to perjury. To swear falsely is held, even by these vagabonds who practise it, to be a dan gerous and disreputable ant. Now, the difficulty with Chinese is to arrive at some means of placing them under the same moral sense of obligation to be truthful which obtains even amongst our lower classes. We do not say that no such means exists, but we cannot find that it has been discovered wherever Chiness are living under foreign law. Here in Hongkong we meet the difficulty by simply warning them that they will be punished if they bear false witness- a process toanifestly absurd, and abso lutely inoperative when the bare word of a native has to be accepted against that of a foreigner, with no possible means of deciding except on the probabilities of the case, Within our own knowledge, st a recent police court case the Chinese witnesses lied, for the simple pleasure of lying, adversely to their own interest The defendant had broken several windows and a couple of pass. The com plainants averred that he had broken only half a dozen pans, though the res value of the latter was below that of the former. In this case the defendant wAS astonished at wilful misstatement which benefitted his case; but it is Dlustrative of a Chinese habit. California, knowing that such is their custom, outs the knot of discussion by saying she will have no Chinese witnesses at all. And until abe discovers the means of exercising some moral fores which will impel 90 per cent. 29.980 to speak the truth in preference to false 29.921 hood, we hold that she is justified. From
