in all respects the Chinn fail is pursue for alleged public, and not for privats libels. For all of which reasons the de fendant, fighting at lung odds, claims th liberty of descruting as freely as he choose on the caso as it is disclosed against him,"
This was our fist avowed intention treating these libels as a matter whic we should regard as exceptional, and w are not without hope that the public ge nerally will, under the peculiar cir cumstances of the case, give with n that our intention is just. But what ha been the effect of the articles which hav since appeared in the China Mail Un was edited by His Excellenty's dis claimei, through the Chief Justino, any ofticisi kuowledge of, or saration to the actions. Others related to the tenur of Macao by the Portuguese. Lord Stan ley's remarks on the "grave and note rious" character of the abuses of th coolie emigration carried on trom Maer elicited some additional observations But not one bore any reference to th merits of the case, er cases, which th learned Attorney General of Hongkong prosecuting or rather delaying to prose cute against the Ching Mail. There not, a syllable in either that can be con strued into a contempt of court Ha they been equally intocnous in respe of the Acting Attorney General of Hong kong, the China Mail would have bee spared the outburst of sploon it had t endure on Thursday last.
The personal reputation enjoyed by th Acting Attorney General is of the ver first class; but professionally he seems t be of a very vindictive character, Thu he won't bring to trial e defendant whi has, as he says, aspersed a friendly m tion, but lets that nation lie under an al leged imputation of a disgraceful wa amanly nature nor will he accept an apology tendered in open Court, by brother barrister; and he invokes th punitive powers of the Court by a wrou pretence on the head of an unoffendiy] journalist. We have not offended agains the Court in any of the remarks that w have made, nor do we intend to enter of the merits of our case until they are dis closed to the public, or until other circum stances may leave us at liberty so to do We feel same amount of pity for th position in which the Suting Attorus General bas placed himself. It is a pat that a loug pralessional life, honorall parsued, should be associated with mund which public opiniori, at home and abrône will pronounce to be one of pure tyrano and oppression. Closer observers wi of course detect a motive for these infor mations, that is hidden from the work at large, and the real reasons for dele in prosecuting them will never porbay become very generally known, because i might be libellous to put them into print But the soreness evinced by the At ing Attorney Generalis easily explainable The case has not turned out as promising as he thought, but that forms no reaso why he should invite the Chief Justice t fine and imprison the China Mail, es b did on Thursday last, for no oflence what ever, nor will it check us in the parsy ance of the intention we have alread announced.
THE Attorney General based his legs right to refuse to bring Regina Sol to trial, mainly on the 60th Geo. II and lat Geo. IV. e. 4, which is (curion) ly enough under the circumsteac-s entitled An Act to prevent delay in administration of justice in cases of wi demeanour." The Hon. Mr Ball eviden ly regards the Act as having been frame with a different intent. The followi is the clause:
That in case any prosecution for a mi demeanour iustivated by his Majesty's a torney or solicitor general in any of th courts aforesaid, shail not be brought trial within twelve calendar months pe after the plea of ilot guilty shall have be
