there is no medium between punishment for manslaughter and absolute escape from the consequences of what the learn ed counsel for the defence termed possi bly reprehensible conduct in beating too severely " We are not amongst those who think that prison life should be made more preferable to the natives than freedom and semi-starvation. But the assumption of excessive power and of the right to inflict punishment on the part of very subordinate gaol employés should be checked with a strong band, and we trust that immediate measures will be taken to that end, as well as to 8 per cont. proinflict some lesser punishment on the accused, who most undoubtedly exceeded their powers, as shewn by the evidence already given. The use of the rattan has, we hear, heen abolished since the Fleath of the deceased Indian. But there are other means of inflicting pain than by the use of a mattan, and the possibly true declaration of the Chinese witness | before referred to, points to this fict.
