Note. The Late Governor held a regular Warrant of Appointment to the Executive Council whilst he held the office of Colonial Secretary. As the officer administering the Government, he presides as of right.
Mr. Sterling holds a Warrant of Appointment to the Executive Council, but sits at present on the Legislative Council under the circumstances given in Despatch No. 1878? 31 Oct. 1867, and approved in Sir Harry Parkes' despatch referred to above.

Messrs. Sterling and Bridges sat during 1854 in this Council in virtue of their official appointments as Chief Justice and Attorney General respectively. Mr. Mercer holds a regular warrant of appointment to the Legislative Council but sits at present in the Executive Council instead as shown under preceding page. The constitution of both Councils is at the present time somewhat confused and undefined — a proposition for their reform in order of preparation for submission to the Home Government.
