18. It shall be lawful for the Governor in Council at any time to declare that

(i) any pipe line or system of pipe lines

(a) for the laying of which permission was given by the Governor under

section 4 when the pipe line was first proposed to be laid

(b) in respect of which notice was given under section 8 aud a decision was given by a magistrate under section 10 when the pipe line was first proposed to be laid

(ii) any pipe line or system of pipe lines necessarily or usually used for the conveyance of crude oil from any such pipe line as aforesaid to any other such pipe line as aforesaid or to any refinery or shipping place for oil shall be deemed to be and be common carriers; and from and after the publication of any such declaration in the Gazette the owners or operators of every such pipe line or system of pipe lines shall at all times in accordance with such rules and regulations as inay from time to time be made by the Governor in Council make full and adequate provision in regard to the carriage of crude oil as such common carriers (and shall if required so to

such do by the Governor in Council increase the carrying capacity of system of pipe lines and the capacity of their pumping stations tanks and other appliances. Provided always that such owners or operators shall not be bound to increase the capacity of their pipe lines, tanks, pumping stations, and other appliances save upon the requisition of producers of crude oil who have given guarantees satisfactory to the Governor in Council of the permanence of the supply of crude oil to be carried by such owners or operators).

Provided (also) that such owners or operators shall not be

any

pipe

line or

(a) required to carry crude oil below a flash point which may from time to time be fixed by the Governor in Council or otherwise than in accordance with rules and regulations to be made as aforesaid;

(b) obliged to place at any one time at the disposal of the public more than twenty per cent. of the full carrying capacity of their pipe lines us then constituted.

19. The rules and regulations in the last preceding section mentioned may among other things

(i) fix a limit to the rates which owners or operators of pipe lines may charge for the carriage of crude oil and for the storage of the same before despatch or at the point of delivery

(ii) define the terms and conditions upon which such owners or operators shall

be bound to carry crude oil

(iii) require such owners and operators to provide all necessary appliances for measuring crude oil and to keep proper records of all oil conveyed by them, as well their own as that of other persons, and to permit all such appliances and records to be inspected, tested, and checked

(iv) attach a penalty not exceeding £20 to the breach of any such rule or

regulation

(v) and provide a method for deciding all questions as to the performance by such owners and operators of their obligations towards the public, including questions as to the damages payable by such owners or operators or other their liabilities for failure to perform such obligations.

20. The Governor in Council may make regulations to provide for the safe and efficient construction, maintenance, and working of pipe lines, storage tanks, and shipping places for oil for the safe transport of handling and dealing with oil and for the safe management of any ship, barge, lighter or other vessel carrying, loading, or discharging oil within the Colony, and may affix a penalty not exceeding £50 or three months' imprisonment for the breach of any such regulation.
