possible. They are however apprehensive that any proposal to appoint a Salaries Com- mission would, at the present juncture, be rejected by the State Council, many members of which are still suspicious that such a Commission will propose overseas allowances in addition to present rates of salary. There is therefore a real danger that the State Council, if they do not actually reject the proposal to appoint a Commission, may seek to restrict the scope of the recommendations of a Commission by imposing conditions (e.g., that overseas allowances should be non-pensionable) which I could not advise Your Lordship to accept. They have therefore decided, I think wisely, to defer con- sideration of this question until after the budget, in the hope that they may be able, after discussion with other members of the State Council, to frame a resolution for the appointment of a Commission in terms which will be acceptable both to the State Council and to Your Lordship.
10. I propose, subject to Your Lordship's consent, to communicate the contents of this despatch and of Your Lordship's reply to the Board of Ministers.

WITH reference to Lord Passfield's Confidential despatch of the 13th July, 1931,* conveying his approval of the regulations relating to the retirement of public officers on pension under Article 88 of the State Council (Order in Council), 1931, I have the honour to inform you that on receipt of that despatch the Civil Service and Public Service Associations were informed in terms of paragraph 3 thereof, and I now enclose for your information a copy of a letter which I have received, signed by the Chairman of both Associations.
3. While I regret that the terms as published should have given rise to disappoint- ment in the Services I must add that I have already given the question my most careful consideration in all its aspects, and I am not prepared to modify the views contained in my Confidential despatch of the 19th May, 1931,† though it will probably be necessary for me to address you further with regard to the commutation tables contained in para- graph 4 of the Regulations, which, I understand, will be the subject of further repre- sentations by the Associations shortly on the grounds that the tables operate inequitably. 4. I take this opportunity to enclose for your information a list of officers who, up to the present have elected to retire under the Regulations.

We have the honour to acknowledge the receipt of your letter of 10th August, 1931, on the subject of retirement of public officers on pension under the Order in Council, 1931, and to inform you that the Secretary of State's reply to the representa- tions made by our Associations has been carefully considered.
2. Our Associations consider that it is important that there should be no mis- conception as to the effect of the Secretary of State's decision on the Services. We, therefore, conceive it to be our duty as representing the two Associations to state that while it is unnecessary to reiterate our past assurance that the Services will do their best to ensure the success of the new Constitution, the terms of retirement as published have aroused in the Public Services a feeling of acute disappointment, and that in our opinion these terms are so inadequate that they make it impossible for the average public servant to avail himself of the right to retire.
