N.B. This declaration must be made before a Justice of the Peace or unofficial police magistrate, an advocate of the Supreme Court, a proctor, notary public, commissioner of oaths, or an officer of the Civil Service of the Island, or a chief headman, and no other. The penalty for a false statement is a fine of one thousand rupees or rigorous imprisonment for six months.

37. (1) Each registering officer shall on or before the fifteenth day of the succeeding month of October revise the register of voters of his registration district.

(2) In revising the register, the registering officer shall insert therein the name of every person who has lodged his claim on or before the fifteenth September or after that date if the registering officer decides to accept it, and is entitled to have his name inserted therein, and shall expunge from the register the name of any person who is dead or has become disqualified or no longer resides in the registration district. The registering officer may also correct any mistake or supply any omission which appears to have been made in the register.

(3) A registering officer who rejects the claim of any person to have his name entered on the register of voters, or expunges the name of any person from the register on the ground of disqualification or non-residence, shall give him written notice of the fact.

38. The registering officer for the Burgher Constituency, with the assistance of the board referred to in Article 32 of this Order, shall revise the registers for each of the registration districts in the Island.

39. On the completion of a revised register, notice shall be given in the Government Gazette and in the principal newspapers circu- lating in the Island in the English language that the revised register for is completed, and that the register, or a copy thereof, is open inspection at all reasonable hours of the day at the Kachcheri of the registration district concerned, or at such other place as shall be specified in the notice.

40.-(1) Every person whose claim to have his name entered on a register of voters has been rejected or whose name has been expunged from a register, and who claims to have it inserted therein (in this registering officer. Order called "the claimant "), may apply to the registering officer

to have his name inserted therein.

(2) Every person whose name appears in the register for any constituency, who objects to the name of any other person or his own name appearing therein (in this Order called "the objector"), may apply to the registering officer to have such name expunged from the register.

(3) Every such application or objection shall be made in the form given below within four weeks from the date of the publication

in the Government Gazette of notice that the rovised register has been completed.

(4) The registering officer shall hold a public inquiry into all claims and objections which have been duly made giving ten clear days' written notice of the date on which the inquiry will commence to each claimant and objector and to each person objected to, and shall fix such notice in a conspicuous place in his court or office.

(5) The registering officer shall insert in the register the name of every claimant having complied with the provisions of this Order, whose claim is proved to the registering officer's satisfaction.

(6) The registering officer shall retain in the register the name of every person objected to, unless the objector appears by himself or by some person duly authorised by him in this behalf in support of the objection and gives prima facie proof of the ground of objection. For the purposes of this provision, prima facie proof shall be deemed to be given by an objector if it is shown to the satisfaction of the registering officer by evidence, repute, or otherwise, that there is reasonable ground for believing that the objection is well-founded, and that by reason of the person objected to not being present for examination or for some other reason, the objector is prevented from discovering or proving the truth respecting the entry objected to.

(7) Where the objector so appears and gives such proof as afore- said, the registering officer shall require proof of the qualification of the person objected to, and if within such reasonable time as the registering officer fixes in this behalf such person's qualification is not proved to the registering officer's satisfaction, he shall expunge his name from the register.

(8) In the case of claims with regard to the Burgher and Com- mercial Constituencies, the registering officer may dispense with the attendance of the claimant, if the claim is, in his judgment, supported by sufficient documentary evidence. In all other cases the claimant must appear in person in support of his claim. It shall be in the discretion of the registering officer whether to require or not to require the attendance of a person objected to.

(9) If an objection is made and fails and, in the opinion of the registering officer, was frivolous and made without reasonable cause, the registering officer may, if he thinks fit, order the objector to pay to the person objected to such sum not exceeding twenty rupees as the registering officer considers reasonable compensation for any loss of time or expenses incurred by the person objected to in consequence of the objection.
