(k) is serving a sentence of penal servitude or imprisonment imposed by any court in any part of His Majesty's dominions or in any country under His Majesty's protection or in respect of which a mandate is being exercised by His Majesty or the Government of any part of His Majesty's dominions for an offence punishable with hard labour or rigorous imprisonment for a term exceeding 12 months, or is under sentence of death imposed by any such court, or is serving any term of imprisonment awarded in lieu of execution of such sentence; or
(1) has been debarred from practising as a legal or medical practitioner by order of any competent authority; or (m) does not have or hold one of the following property
qualifications, viz. :——
(i) The possession or enjoyment of a clear annual income of not less than 1,500 rupees, such possession or enjoyment having subsisted during the whole of a period of 12 months immediately prior to the date of his nomination as a candidate for election;
(ii) The ownership of immovable property either in his own right or in right of his wife (but not as lessee or usufructuary mortgagee), the value of which (after allowing for any mortgage debts thereon) is not less than 6,000 rupees;
(iii) The occupation as owner or tenant, during the whole of a period of 12 months immediately prior to the date of his nomination as a candidate for election, of any house, warehouse, counting-house, shop, or other building (in this section referred to as qualifying property) of the annual value of not less than--
(a) 500 rupees if situated within the limits of any Municipal, Local Board, or Sanitary Board town, or of any Urban District Council, or of the Board of Improvement of Nuwara Eliya; and
(b) 400 rupees if situated elsewhere.
(2) The qualifying property need not be, throughout the year constituting the period of qualification, the same property, if the annual value is in no case less than 500 rupees or 400 rupees, as the case may be.
(3) The terms "house, warehouse, counting-house, shop, or other building" include any part of a building when that part is separately occupied for the purpose of any trade, business, or profession; and any such part may, for the purpose of describing the qualification, be described as office, chambers, studio, or by any other like term applicable to the case.

(4) Where an occupier is entitled to the sole and exclusive use any part of a building, that part shall not be deemed to be occupied otherwise than separately by reason only that the occupier is entitled to the joint use of some other part.

(5) For the purposes of this Order, "Government contractor means a person having a direct or indirect pecuniary interest in a contract with the Government of the Island for or on account of the public service otherwise than as a member and in common with the other members of an incorporated company consisting of more than 25 members.
15. If any elected member shall die or become disqualified for election as a member, or shall, by writing under his hand addressed to the Governor, resign his seat in the Council, or shall make any declaration or acknowledgment of allegiance to any foreign State or Power, his seat in the Council shall thereupon become vacant.

17. Every person returned as an elected member who, being Penalty for

CONSTITUENCIES.
18.-(1) For the purpose of the election of members to serve Constituencies
and designations in the Council, the following shall be constituencies, viz. :—
of members. The following communal constituencies :-
(i) The European Urban Constituency, the member for which shall be designated "the European Urban Member ";
(ii) The European Rural Constituency, the member for which shall be designated "the European Rural Member ";
(iii) The Commercial Constituency, the member for which
shall be designated "the Commercial Member ";
(iv) The Burgher Constituency, the members for which shall be designated "the First (or Second) Burgher Member, according to their order of precedence;
(v) The Muslim Constituency, the members for which shall be designated "the First (Second or Third) Muslim Member, according to their order of precedence;
(vi) The Indian Constituency, the members for which shall be designated "the First (or Second) Indian Member, according to their order of precedence;
(vii) The Western Province (Ceylon Tamil) Constituency, the member for which shall be designated “the Colombo Tamil Member;
and the following territorial constituencies :-
(viii) Colombo Town (North), the member for which shall
be designated "the Member for North Colombo ";
(ix) Colombo Town (South), the member for which shall be designated" the Member for South Colombo ";
(x) Colombo District, the member for which shall be
"the Member for the Colombo District " designated (xi) Negombo District, the member for which shall be
designated "the Member for Negombo ";
(xii) Kalutara Revenue District, the member for which
shall be designated "the Member for Kalutara "; (xiii) Central Province (Urban Division), the member for
which shall be designated "the Kandy Urban Member";
