108.-Compounding a Felony or Misdemeanour.

Any person who asks for, receives, or obtains, or agrees or 0. 133. attempts to receive or obtain, any property, or the possession of any property, or any benefit of any kind, for any person, upon any agreement or understanding that he will compound or conceal a felony or misdemeanour, or procure any such com- position or concealment, or will abstain from, discontinue, or delay a prosecution for any felony or misdemeanour, or procure any such abstention, discontinuance or delay; or withhold any evidence of the commission of any felony or misdemeanour, or procure such evidence to be withheld, is guilty of a misde.

CHAPTER IX.--ESCAPE.

110.-Escape from Custody.

Any person who

(1) having been convicted of any felony or mis- demennour escapes from any lawful custody in which he may be under such conviction; or

(2) whether convicted or not, escapes from any prison in which he is lawfully confined on a charge of any felony or misdemeanour;

is guilty of felony.

Any person who being in lawful custody, otherwise than aforesaid, on a charge of any felony or misdemeanour escapes - from such custody; and any person, who whether convicted or not, escapes from any prison in which he is lawfully confined on a charge of any simple offence, or for any other reason, is guilty of a misdemeanour and also of a simple offence.

111.—Rescue, and aiding Escape in certain Cuses.

Any person who rescues any other person from lawful. custody shall be deemed to have aided him in escaping there- from, and he punishable accordingly; and

any person who aids any other person in escaping from,

or rescues such other person from, any lawful custody in which such other person is under sentence of, or on charge of an offence punishable with death or penal servitude for life, is liable to penal servitude for life.

112.—Conveying Means of Escape into Prison.

Any person who, with intent to facilitate the escape of any person lawfully imprisoned, conveys or causes to be conveyed anything whatever into any prison, is guilty of a misdemeanour,

113.—Offences by Peace Officers or Officers of Prisons. Any peace officer having any person in his lawful custody, B. 135-6-8. or any officer of a prison in which any person is lawfully confined, for any cause, who voluntarily and intentionally permits such person to escape, or aids him in escaping or attempting to escape from such custody or prison respectively, is guilty of felony ;

And if such person is under a sentence of death or penal servitude for life, or is in custody on a charge of an offence. punishable with death or penal servitute for life, the offender is liable to penal servitude for life.

114.—- Rescuing or permitting the Escape of Luneties. Any person who

(1) rescues any person lawfully ordered to be confined in any lunatic asylum, or place where lunatics may by law be confined, either during the time of his conveyance. thereto, or of his confinement therein; or

(2) being in charge of such person during his con- veyance as an insane person to any such lunatic asylum or place, wilfully permits him to escape from custody; or

(3) being a person employed in any such lunatic asylum or place, wilfully permits a person confined therein as an insane person to escape therefrom; or

(4) conceals any such person who has to his knowledge been rescued during such conveyance or confinement, or who has to his knowledge escaped during such conveyance, or from such confinement,

is guilty of a misdemeanour.

115.-Imprisonment under irregular Warrants.

For the purposes of the five last preceding sections, confine- ment under an irregular warrant or other irregular process shall be deemed to be lawful.
