Article 1. The Contractors shall, subject as hereinafter provided, and to the due performance by

of the agreements and conditions hereinafter contained, and on their part to be ob- served and performed, and for the considerations and upon the terms hereinafter expressed, make and complete for the

submarine telegraph cables of the respective lengths and types mentioned in the Speci- fication hereunto annexed, and therein described as Section A, Section B, and Section C respectively, subject to and in accordance with the conditions contained therein, and the Contractors shall lay down as much thereof as shall be necessary for the under- mentioned telegraph cables, namely :-

Section A. From Fiji (Suva) to Norfolk Island (Sydney Bay). Section B. From Norfolk Island to Queensland (Moreton Bay). Section C. From Norfolk Island to New Zealand.

Article 2. The Cable snall be manufactured and constructed throughout of thoroughly good materials and workmanship, in all respects in strict accordance with the said Specification, which is to be treated as part and parcel of this Contract, and as binding as any portion hereof.

Article 3. After the Cable shall have been made, and shall have been tested and approved by the Company's Engineer (hereinafter called "the Engineer"), the Contractors shall cause the whole of the same to be coiled on board a suitable steam vessel or vessels, supplied at their own cost and risk, including coals, crews, and provisions. Such steam- ship or steamships shall each be provided for the stowage of Cables with iron water- tight tanks of suitable dimensions and construction, thoroughly secured; each ship shall also be provided with a suitable testing room or rooms, and shall be fitted with all necessary machinery for laying and testing the cables, buoying, grappling, picking up, repairing, &c., including electric instruments and batteries; they shall also be equipped with a full and sufficient cable staff. The Contractors will also pro- vide, at their own cost and risk, all steamboats, barges and appliances necessary for laying the Cable.

The Contractors shall so arrange for the shipment and laying of the Cable that the several sections of Cable, viz., between Fiji and Norfolk Island, between Norfolk Island and Queensland, and between Norfolk Island and New Zealand, shall be laid on one expedition, and the direction of laying of Section A. whether to or from Norfolk Island shall be decided by the Engineer subject to the approval of

In accordance with the conditions of the tender, samples of the materials which will be used in the manufacture of the Cable must be submitted to the Engineer as well as a specimen of each type of Cable specified for.

The whole equipment of the ship and other vessels, as aforesaid, to be to the satisfaction of the Engineer.

Article 4.. The Engineer, or his staff of assistants, shall, at all reasonable times during the manufacture of the Cable be allowed by the Contractors free access to their works for the purpose of inspecting and testing the Cable during the process of manu- facture, of testing the same after manufacture, and generally for the purpose of satis- fying themselves that the Core and all materials that go into the Cable are in accordance with the Specification,

Every facility, including batteries and instruments for testing, shall be afforded to the Engineer and his assistants to test every part of the Cable during shipment and transport.
