I HAVE the honour to acknowledge the receipt of your despatch, No. 23, of tlie 17th October,* reporting that you are taking steps to give effect to the regulations on the subject of flogging, suggested in my circular despatch of the 25th May, 1897.

2. I have to request that steps may also be taken, if this has not been already done, for limiting by law the number of strokes to be inflicted in all cases to a number not exceeding 24, whether awarded by a Court or as a punishment for a prison offence.

I HAVE to express my humble apologies for having inadvertently neglected to reply to your circular, dated 25th May, 1897, in respect to the Colony of Labuan.

I am taking steps now to give effect to the Regulations suggested at the end of the circular.

I have the honour to enclose a table giving the information required concerning the years 1896, 1897, and I shall see that a return is forwarded each year as required.

I HAVE the honour, in compliance with the instructions contained in your circular despatch of 25th May, 1897, to transmit a return of corporal punishments inflicted in the Freetown Gaol during the year ended 31st December, 1898, which has been prepared by the Keeper of the gaol.

2. It will be observed in the return that there were only 12 cases of flogging, awarded as follows:-

1 by his Honour the Chief Justice, 12 strokes.

8 by Visiting Justices, strokes varying from 6 to 12.

3 by District Commissioners of the Protectorate, 1 of 6 and 2 of 36 strokes each.

In each of the last two cases, in which the maximum number of 36 lashes were inflicted, the prisoners were convicted of assault with intent to do grievous bodily harm, and as

I considered that the award was justified by the attendant circumstances, I confirmed it accordingly.

The instrument used is a light rattan applied to the buttocks, as provided in the Indian Code of Criminal Procedure.
