I AM in receipt of your Circular Despatch dated 25th May 1897 on the question of flogging as a punishment for crime and more especially as a punishment for prison offences. The subject is an important one, for no right minded man would wish for pain to be inflicted where it can possibly be avoided.
2. With native races there are occasions when the application of the cat is unfortunately the only thing which a coarse brutal nature can be made to feel. In this colony, however, I am glad to be able to report that the character of the native is such that flogging has rarely to be resorted to. I enclose a return from which you will see that from June 1896 to June 1897 only three prisoners were subjected to corporal punishment, whilst five more cases in which prisoners were guilty of larceny were similarly dealt with by order of the convicting Magistrate.
3. Corporal punishment for prison offences is regulated by Sections 66 to 68 of Ordinance IX. of 1876, and is so seldom inflicted that it appears unnecessary to make any change in the law. I note, however, that you desire an annual return to be sent to you, and I have given orders that no flogging for a prison offence shall be carried into effect until my written approval has been obtained.

By the advice of my Ministers I have given my sanction to the proposed Regulations with the amendment as shown in italics.
