duties, especially at night time, without his permission. She shall not punish any female officer or prisoner except under his instructions.

31. She shall accompany every male officer who enters the female prison for purposes of inspection.

32. She shall inspect every part of the female prison once a day, and at least once a week at an uncertain hour in the night.

33.

She shall keep a journal in which shall be noted daily the state of the female prison, and of the prisoners, the labour performed, punishments, absences, visits, and any unusual occurrence.

MEDICAL OFFICER.

(See Rules 14, 49, 50, 66, 67, 72, 76, 88, 105, 109, 114, 117.) 34. The medical officer shall examine every prisoner as soon as possible after admission and also prior to discharge. He shall record the prisoner's health, on each occasion, in the nominal record, making such special comments as he may consider desirable. He shall visit any prison officers who are reported to be ill.

35. He shall once in every three months inspect every part of the prison and make a report in writing to the keeper, for transmission to the Colonial Secretary, upon the sanitary state of the prison, the health of the prisoners, and the quantity and quality of the diets.

36. He shall see every prisoner once a week. He shall visit daily, and oftener

or in solitary confinement if necessary, any prisoners who are sick punishment cells. He shall from time to time inspect the prisoners while at hard labour, and give written instructions for such modifications of labour, diet, and punishment as he may consider to be necessary.

37. He shall examine every prisoner sentenced to corporal punishment before the punishment is inflicted, and shall be present while it is being carried out. He shall give such orders for preventing injury to health as he may deem necessary, and it shall be the duty of the keeper to carry them into effect.

38. He shall keep a journal in which shall be entered day by day his comments on the state of the prison and the prisoners, and a case book in which shall be noted full particulars of all cases of illness and of death.

39. He shall be careful to make a special report whenever he is of opinion that the life or the reason of a prisoner is endangered by continuance of imprison- ment, or that he is wholly and permanently unfit to undergo prison discipline.

MINISTERS OF RELIGION.

(See Rules 15, 20, 109, 116, 117.)

40. Arrangements shall be made for ministers of the Christian religion to hold services on Sunday, Christmas Day, and Good Friday, and to visit prisoners In cases of of their own denomination at reasonable times during the week. serious illness the minister of the denomination to which the sick prisoner belongs shall be specially apprised.

41. In default of a duly appointed chaplain, daily prayer in a form approved by the Governor shall be read by the keeper of the prison.

VISITING JUSTICES.

42. The visiting justices shall consist of members of the Executive Council who shall have access to the prison at all times, of the police magistrates,* and of such visiting justices as are annually appointed by the Governor. They shall form a board the chairman of which shall be annually appointed by the Governor, and shall arrange for visits to the prison at least as often as once a month in addition to such visits as may be directed by the Governor. Surprise visits should be paid from time to time.

43. They shall on every visit hear every complaint which any prisoner may wish to make to them, and shall especially inquire into the condition of the sick and of those prisoners who are undergoing solitary confinement. They shall at stated intervals test the diet, examine all the books, and inspect all the prisoners.

44. They shall have such power to award punishments as is given them by the Prison Ordinance or by these rules. (See Rules 107, 108, 110, 112.)

ADMISSION OF PRISONERS.

45. On admission every prisoner shall be photographed, and his name, age, height, weight, particular marks, and general appearance shall be registered by the keeper of the prison in the nominal record. (See Rule 23 (a.))

46. Every prisoner shall be searched on admission by an officer of his or her own sex, not in the presence of any other prisoner.

47. All prisoners, other than persons detained for safe custody, shall have their private clothes and all other articles whatever not expressly allowed by the rules taken from them, entered in the inventory book, and put away, excepting anything of a perishable or dangerous nature, which may be destroyed.

48. Male and female prisoners alike, with the exception mentioned in the preceding rule, shall be dressed in prison clothes, but the hair of female prisoners shall not be cut either on admission or afterwards unless the medical officer shall consider it to be necessary for health and cleanliness. Every prisoner shall take a bath on admission, unless it shall be otherwise ordered by the medical officer.

49. Every prisoner, male or female, shall be examined as soon as possible after admission by the medical officer. (See Rule 34.)

DISCHARGE OF PRISONERS.

All prisoners prior to being removed or discharged shall be examined by the medical officer, and no prisoner shall be discharged, except upon his own requisition, while labouring under any acute or dangerous disorder, nor until the medical officer shall certify that such discharge is safe. (See Rule 34.)

51. On the discharge of a prisoner, the clothes in which he was admitted and any other articles which he brought with him on admission shall be returned to him, unless it has been found necessary to destroy the clothes, in which case suitable clothing shall be provided at the Government expense.

52. If the date of release falls on a Sunday, Christmas Day, or Good Friday, the person

shall be released on the preceding day. 53.

No prisoner can, in consequence of misconduct while in prison, be detained in prison beyond the expiration of the term of imprisonment to which he was sentenced by a court of law, unless he has been again brought before a court of law and received a fresh sentence.

54. At the discretion of the Governor any prisoner whose home is more than ten miles distant from the prison may, if he or she wishes to be sent home on being discharged, be sent at the Government expense. See also Rule 18; Rules 82-96 as to the mark system; and Rule 99 as to earning gratuities.

SEPARATION OF PRISONERS.

55. Separation, within reasonable limits, and combined with hard and whole- some work, is the basis of sound and humane prison discipline. Male and female prisoners shall be kept absolutely separate from each other and shall, if possible, be confined in different buildings. Juveniles* shall be kept absolutely separate from adults. Prisoners awaiting trial, or undergoing imprisonment under civil process, or in default of security, shall be kept separate from convicted criminals, and first offenders from habitual criminals. This separation shall be strictly maintained, both by day and by night, in the hospital or infirmary as well as in other parts of the prison.

56. Soldiers convicted of breaches of discipline only shall not be sent to the criminal prison, unless no other arrangements can be made. If confined in that prison they shall be kept wholly apart from ordinary criminals.

57. Every male prisoner shall, if the accommodation of the prison permits, be confined at night in a separate cell, duly certified as sufficient to contain one prisoner. If, from want of a sufficient number of certified separate cells, it is necessary to place prisoners in association, the smallest number to be placed in
