Petition of right will not lie for mere negligence on the part of the servants of the Crown, but it will lie to recover damages for breach of contract. If canse of complaint against a Governor is founded on contracts, or have relation to land, a petition of right will lie against the Crown for such acts of the Governor as are acts of State.
