AN ORDINANCE TO RAISE EXPORT DUTIES ON PALM KERNELS.

1916.]

BE IT ENACTED by the Governor of the Gold Coast Colony, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as the Palm Kernels Export Duty Ordinance, 1916.

2. In this Ordinance the term "exporter " shall include any owner or other person for the time being possessed of or beneficially interested in any palm kernels from the time when an application is made for authority to export the same under section 5 hereof, or from the time the same are placed in any boat, canoe, or other craft whatsoever, for the purpose of being exported, whichever time shall first occur until such palm kernels shall be conveyed out of the territorial waters of the Colony.

3. Subject as provided in section 13 hereof there shall be raised, levied and collected and paid unto His Majesty for the Government of the Gold Coast Colony an export duty at the rate of two shillings per hundredweight or part thereof net weight on all palm kernels exported from the Colony.

4. It shall be lawful for the Governor in Council from time to time by Order to increase, or reduce, as he thinks fit the amount of duty made payable by this Ordinance and on such Order being made the provisions of this Ordinance shall apply as if the duty so fixed were inserted in place of the duty specified in section 3 hereof.

5. A person desiring to export palm kernels may apply to the Senior Customs Officer at Application for authority to ex- the port from which he desires to export them for an authority to so export. Such application shall be in duplicate in form A in the Schedule hereto and shall set forth the name and address of the exporter, the place and the person to whom such palm kernels are to be consigned, the quantity of palm kernels he intends to export, a description of the bags or receptacles and all marks thereon in which he intends to export such palm kernels, the gross and net weight per package, and the port from which, the ship on which, and the occasion of the calling of such ship at such port on which he intends to export such kernels. The duplicate when signed and sealed by such officer shall be the authority for shipment.

6. On receipt of such application and a bond with such securities and in such terms and on such conditions as such officer may require for the passing of the proper Bills of Entry and the payment of the duty such officer shall issue an authority as set forth in section 5 hereof for the exportation of such palm kernels.

Such bond may be given in respect of each particular consignment or may be given. generally with respect to any number or all consignments.

7. No palm kernels shall be placed in any boats, canoes or other craft whatsoever or carried to any ship or shipped or transhipped for exportation unless the authority specified in section 6 hereof has been obtained and except at such places and at such times and in the presence of such officers as provided and required by law with respect to the importation. of goods.

8. The master, owner, and agent of an owner of any ship on which palm kernels shall be placed for the purpose of exportation, before an authority to export the same shall have been issued under section 6 hereof, or in greater quantity or in bags or packages other than specified and described in such authority shall be guilty of a misdeamenour.

9. No palm kernels shall be placed for exportation on a ship other than the ship specified

in any authority to export such kernels, and no palm kernels shall be placed on a ship for exportation at any time except on the occasion of calling at the port specified in such authority.

The master, owner, and agent of an owner of a ship on which palm kernels shall be placed contrary to the provisions of this section shall be guilty of a misdemeanour.

13. In case an exporter of palm kernels shall produce to the Comptroller of Customs No duty payable within four months from the date of exportation thereof, or within such further period as in respect of the Comptroller may allow a certificate signed by an owner of, or the Secretary of, any crushed at a mill
