IN continuation of my letter of the 13th November,* on the subject of the penal liabilities of Indian indentured labourers in the Colonies, I am directed by the Marquess of Crewe to transmit, for the consideration of Mr. Secretary Harcourt, a copy of further correspondence received from the Government of India.
As the suggestion made by the Government of India is in accordance with the view expressed in Mr. Read's letter of the 29th July last (No. 21039), † His Lordship has requested Mr. McNeill and Mr. Chimman Lal to report on the subject after consultation with the Colonial Governments.
At the same time, His Lordship agrees with the Government of India that, after the lapse of a reasonable time for the re-examination by the Colonial Adminis- trations of their labour laws, it will be necessary to arrange that a clear statement of the penalties to which labourers and employers respectively are liable for breach of engagements should be made to all intending emigrants.

We have the honour to refer to Your Lordship's Despatch No. 172, Public, dated the 13th September, 1912, regarding the proposed insertion in the terms of service From the Government of Madras, No. 817, imposed upon indentured emigrants in the and in the agreement of the penalties Colonies by the special labour laws, and to forward a copy of the replies which have been received from the Local Governments consulted on the subject.

2. Your Lordship will observe that none of the Local Governments have raised any objection to the proposal, and that the Government of Bengal, while counselling post- ponement of action to allow the Colonial Governments a full opportunity of amending their labour laws, consider that effect should be given to it, even at the risk of Colonial emigration from India being seriously discouraged as a consequence. observed that the Government of the United Provinces is also so impressed with the It will be further desirability of informing intending emigrants of their peual liabilities in the Colonies that it proposed to take immediate steps in that direction. We agree with Your Lordship and Mr. Harcourt that it would not be fair to draw the special attention of intending emigrants to the penalties which they may incur without making it equally clear that their employers are liable to penalties for breach of Your Lordship will observe that our attention has been drawn to this aspect of the question by His Honour the Lieutenant-Governor of Bihar and Orissa. We further agree that no action should be taken in the direction contemplated without a full dis- cussion of the subject with the Colonial Governments, and that they should, as suggested
