ten years, retires in circumstances in which he is permitted by the Ordinance to retire on pension it shall be lawful to grant him a

pension instead of a gratuity in respect of his service in the Colony.

(6) Where service in the Colony has been preceded by other public service

in part or the whole of which the pension scale is the fiftieth scale or a fortieth scale there may be granted an addition to the pension chargeable on the revenues of the Colony under (2) which shall be computed on the basis of one three-hundredth part as above mentioned on the same principle as the pension computed under (2). but only pensionable service on the fiftieth and fortieth scales shall be taken into account.

Provided always that if the said officer is at the date of retirement receiving lower pensionable emoluments than those which he had received in other public service and, as a result thereof, the pension computed as above, including additions, would be less than one-fiftieth of his pensionable emolu. ments at the date of retirement for each complete year of his service in the Colony, he may, with the approval of the Secretary of State, be granted a pension calculated under Regulation 1, notwithstanding that his service in the Colony may have been less than ten years.

Provided also that if the said officer has been employed in other public service in which pensions may be granted after less than ten years' service, for the period qualifying for pension in such service, and, before completing an aggregate service of ten years, retires in circumstances in which he is permitted by the Ordinance to retire on pension it shall be lawful to grant him a pension instead of a gratuity in respect of his service in the Colony,

For the purpose of this Regulation the expression "sixtieth scale" includes an eightieth scale combined with a lump sum allowance as provided in the Imperial Superannuation Act, 1909.

C.

(b) Where service in the Colony has been preceded by other public service in the whole of which the pension scale is the fortieth scale laid down in the latter part of Regulation 1, or partly by such other service and partly by service in which the pension scale is a sixtieth scale, there may be granted an addition to the pension chargeable on the revenues of the Colony under (2) which shall be computed on the basis of a one hundred and twentieth part as above mentioned on the same prin- ciple as the pension computed under

(2), but only pensionable service on the fortieth scale shall be taken into

account.

(c) Where service in the Colony has been preceded by other public service in part or the whole of which the pen- sion scale is a fiftieth scale, there may be granted

(i) an

addition to the pension chargeable on the revenues of the Colony under (2) which shall be computed on the basis of one three-hundredth part (being the difference between one-fiftieth part and one-sixtieth part) of the said pensionable emoluments on the same prin- ciple as the pension computed under (2), but only pensionable service on the fiftieth and fortieth scales shall be taken into account; and

(ii) a further addition which shall

be computed on the basis of one two-hundredth part (being the difference between fortieth part and one-fiftieth part) of the said pensionable emoluments on the same prin- ciple as the pension computed under (2), but only pensionable service on the fortieth scale shall be taken into account. Provided always that if the said officer is at the date of retirement receiving lower pensionable emoluments than those which he had received in other public service and, as a result thereof, the pension computed as above, including additions, would be less than one-sixtieth, or one-fortieth in the case of a European officer, of his pensionable emoluments at the date of retirement for each complete year of his service in the Colony, he may, with the approval of the Secretary of State, be granted a pension calculated under Regulation 1, notwith- standing that his service in the Colony may have been less than ten years, or seven years in the case of a European officer.
