16. The provisions of this Ordinance shall apply to all officers serving in the Colony at or after the commencement of the Ordinance and to those who, having served in the Colony, have before the commence. ment of the Ordinance been transferred to other public service; and the Pensions Ordinance and Regulations specified in the second Schedule to this Ordinance are hereby repealed, provided as follows:-

(1) Subject to the provisions of section11,

nothing in this Ordinance con- tained shall affect the amount of the pensions of any persons who have retired before the commence- ment of the Ordinance or the conditions under which such pen- sions were granted;

(2) If any officer to whom this Ordinance applies claims by written notice sent to the Colonial Secretary within one year from the commencement of the Ordinance to have his pension on his final retirement calculated under the previous law or regulations which applied to him immediately before the commencement of the Ordin- ance, his pension shall be calcu- lated under such previous law or regulations;

(3) If any officer who has claimed to

have his pension on final retire- ment calculated under the previous law or regulations as provided in (2) is subsequently transferred from the service of the Colony to other public service, he may with- draw such claim by written notice sent to the Colonial Secretary within one year from the date of euch transfer.
