THE GAME ORDINANCE, 1911. PROCLAMATION.

"it is provided that the Whereas by Section 38 of " The Game Ordinance 1911 Governor in Council may suspend the operation of the said Ordinance or parts thereof in respect of portions of districts.

And whereas it has been made to appear to me expedient that the operation of the said Ordinance, with the exception that elephants (female or young) and all the birds mentioned in Schedule I to the Ordinance shall not be hunted killed or cap- tured, in so far as it relates to natives should be suspended in respect of the portion of the Dowa Sub-district of the Lilongwe District the boundaries of which are as described in a Notice No. 13 dated the 30th of December 1911 and published in the Gazette of that date:

Now therefore by virtue of the powers in me as Governor in Council vested as aforesaid I do hereby proclaim and declare that the operation of the said Ordinance subject to the exception as aforesaid in so far as it relates to natives shall be and is hereby suspended in respect of the portion of the Dowa Sub-District of the Lilongwe District hereinbefore described until further notice: Provided that if elephants be killed in pursuance of the provisions of this Proclamation the tusks thereof shall be deemed to be the property of the Government.

2. The enclosures to my despatch above referred to show how the conclusions were arrived at, with the exception of the alteration of the boundaries of the Toro game reserve, which have been reduced in accordance with arrangements made by Mr. Jackson, on consultation with the district officers, after his last tour in the Western Province.

3. I transmit also for your consideration a copy of a letter from the Chamber of Commerce dealing with the increase in the weight of ivory, together with a copy of my reply thereto. This question is also dealt with in the third paragraph of your despatch, No. 127, of The 7th April, 1911,† action in respect to which was deferred in order to allow of all outstanding questions being considered under a revised Game Ordinance, now submitted.

4. The opinion of the Committee regarding the question of the appointment of game rangers is contained in paragraph 19 of enclosure (a) to my despatch, No. 405, of the 7th October, 1912.

An addition has been made to the definition of " hunt, kill or capture," by

words taken from Section 6 of the Uganda Game Ordinance, 1910.
