Before giving effect to this suggestion, however, the whole of the documents and correspondence between the parties prior to the date of the Agreement should be carefully investigated. The Bill of Costs rendered to the Railway Company or its promoters by Messrs. Hollams and Company, giving an account of the various interviews to which Messrs. Hollams and Company were parties, would no doubt throw some light on the point.

(per W.S.R.)
MY LORD,
21st May, 1909. WE were honoured with your Lordship's commands, signified to us in Mr. Antrobus's letter of the 28th April last, stating that he was directed by Your Lordship to transmit to us a despatch from the Governor of British Guiana, enclos- ing a petition in which Richard Driver, as attorney of George Wellington Gibbs, appealed against the Governor's refusal to grant a fiat for the prosecution of Gibbs's claim against the Government of the Colony for wrongful imprisonment.
That Mr. Antrobus was also to enclose, for our information, correspondence with the Foreign Office and the Governor of British Guiana, from which it would be gathered that, at the request of the Cuban Government the Governor was instructed to procure the issue of a warrant for the apprehension of one Cuevas, and that under this warrant Gibbs was arrested.
That Mr. Antrobus was to request that we would be good enough to take these papers into our consideration and report,
(1) Whether, in our opinion, the Governor of British Guiana rightly exercised his discretion in refusing the fiat for which Gibbs applied?
ཟ
(2) If not, what course should be adopted with regard to the petition made on behalf of Mr. Gibbs to the Secretary of State?
(3) Generally.
We have taken the matter into our consideration, and, in obedience to Your Lordship's commands, have the honour to
Report-
1. That in our opinion the Governor of British Guiana rightly exercised his
discretion in refusing the fiat for which Mr. Gibbs applied.
This question does not arise.
3. We have nothing to add.
The Right Honourable
We have, &c.,
