[Whether Bank of England Notes are Legal Tender in the Gambia.]
Royal Courts of Justice,
May 4, 1903. We were honoured with your commands signified in Mr. H. Bertram Cox's letter of the 15th April last stating that he was directed by you to lay before us a confidential despatch, dated 17th February, from the Governor of the Gambia, together with the opinions of the Chief Magistrate and Attorney-General' transmitted there- with.
That Mr. Bertram Cox was to request us to be good enough to take the papers into our consideration and to report whether, in view of the provisions of the Aet 3 and 4 William IV., Cap. 98, and section 17 of the Supreme Court Ordinance of the Gambia, Bank of England notes were, or were not, legal tender in the Gambia.
We have taken the matter into our consideration, and, in obedience to your commands, have the honour to
Report-
That in our opinion Bank of England notes are not legal tender in the Gambia. To avoid any question being raised, and having regard to the opinions of the Chief Magistrate and the Attorney-General of the Gambia, we think it might be advisable to make the matter clear by passing an Ordinance to that effect.
