Whether the Agreement should extend to natives of other States than Siam and the Malay States is a question of policy on which we have not the materials for expressing an opinion; if this is desirable it might be rendered workable in practice if the Resident has a discretion as provided in the Enactments 4 of 1900 of Perak and 12 of 1901 of Pahang. 3. We think the crimes ought in each case to be set out in the Schedule, and the Enact- ments and the Agreement ought to correspond; at present they differ in several respects, The request for surrender is, in the Enactments, to be made to the Resident, and not, as in the Agreement, to the Government, and the Resident has a discretion which is not given in the Agreement to the Government,

[Proceedings of the "Ban Righ" or "Bolívar."]
Royal Courts of Justice, April 15, 1902. We were honoured with Your Lordship's commands, signified in Mr. Villiers's letter of the 12th instant, stating that he was directed by Your Lordship to transmit to us a copy of a letter from the Colonial Office enclosing a telegram and two despatches from the Governor of Trinidad relative to the recent proceedings of the steamship "Ban
or "Bolivar,' Righ
That Mr. Villiers was to request that we would take the letter and enclosures into our consideration and would favour Your Lordship with our opinion on the following points:-
1. Whether the action of the Governor of Trinidad should be approved?
2. What instructions should be sent to the Governor in reply to his telegram of the 10th instant stating that the Colombian Consul for the island had telegraphed for a Colombian man-of-war to tow the "Ban Righ" from Port of Spain or to remove the arins from her, and asking whether there was any objection to either course with or without assurance from the Colombian Government that neither vessel nor arms would be used against Venezuela ?
That Your Lordship would be glad at the same time to be favoured with any observations of a general nature which we might have to offer on the papers.
We have taken the matter into our consideration, and in obedience to Your Lordship's commands, have the honour to
Report-
1. That we think that the action of the Governor may be approved.
2. We see no objection to permitting a Colombian man-of-war to remove the “Bolivar" in tow, or to take on board the arms and ammunition which are now on the "Bolivar."
The first of these courses would be much preferable, but we do not think that assurances of any kind need be insisted on with regard to either.
