We were honoured with your commands signified in Mr. Bertram Cox's letter of the 11th instant, stating that he was directed by you to transmit to us a copy of a despatch (with one enclosure) from the Governor of New Zealand, dated the 4th May, 1899, relative to the appointment of the Chief Justice for the time being of the Cook Islands Protectorate to be a Judicial Commissioner for the purposes of the Pacific Order in Council, 1893, within the limits of that Protectorate, together with a copy of the despatch which you had addressed to the Earl of Ranfurly in reply thereto.

That Mr. Bertram Cox was also to enclose a copy of the draft of an Order in Council which you had caused to be prepared to effect that object by amending the Pacific Order in Council, 1893, and to enquire whether in our opinion it was sufficient for its purpose,

Order in Council Amending the Pacific Order in Council, 1893.

WHEREAS it is expedient to amend the Pacific Order in Council, 1893 (hereinafter called the principal Order), so as to enable the Chief Justice for the time being, of the High Court of the Cook Islands Protectorate to be appointed a Judicial Commissioner for the purposes of the principal Order.

Now therefore Her Majesty, by virtue and in exercise of the powers in this behalf by the British Settlements Act, 1887, the Pacific Islanders Protection Acts, and the Foreign Jurisdiction Act, 1870, or otherwise in Her, Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows :-

1. This Order may be cited as the Pacific Order. in Council, 1893, Amendment Order, 1899, and shall be read and construed as part of the Pacific Order in Council, 1893.

2. The High Commissioner may from time to time, in the name and on behalf of Her Majesty, by writing under his hand and seal, appoint the person for the time being holding the office of Chief Justice of the High Court of the Cook Islands Protectorate to be a Judicial Commissioner for the purposes of the principal Order.

A Judicial Commissioner appointed under this Order may be suspended or removed by the High Commissioner by writing under his hand and seal showing the grounds of suspension or removal, and the saine shall be reported forthwith to the Secretary of State.

A Judicial Commissioner appointed under this Order shall cease to be a Judicial Commissioner on ceasing to be the Chief Justice of the High Court of the Cook Islands Protectorate.

A Judicial Commissioner appointed under this Order shall exercise the jurisdiction of the High Commissioner's Court within the limits of the Cook Islands Protectorate and not elsewhere.
