WE were honoured with your commands signified in Mr. Edward Wingfield's letter of the 2nd instant, stating that he was directed by you to transmit to us the accompanying copy of a Memorandum, prepared for the Board of Trade by Mr. J. E. Scrutton, upon an Act recently passed by the Legislature of Natal. entitled "An Act to leclare the Law affecting Playrights (No. 44 of 1898)."

That we should observe that Mr. Scrutton's Memorandum raised certain important questions in connection with the law of Copyright upon which you would be glad to have our opinion before communicating with the Governor of Natal on the subject of the Act, in regard to which you had not yet tendered any advice to Her Majesty.

That Mr. Wingfield was to request that we would take the papers into our consideration and favour you with our views on the following points :—

(1) Whether the effect of the Natal Act (No. 44 of 1898) was to repeal the Imperial Act 3 William IV.. Cap. 15, known as the Bulwer Lytton Act, so far as the latter Act gave playright in Natal without the nece sity of registration.

(2) Whether, if so, such repeal was within the powers conferred upon the Legislature

of a British Possession by Section 8 (4) of the Imperial Act 49 and 50 Vict., Cap. 33 ?

(3) Whether Her Majesty might properly be advised not to disallow the Natal Act? (4) Generally.

We have taken the papers into our consideration, and, in obedience to your commands, have the honour to

Report-

The

(1) That we are of opinion that the effect of the Natal Act (No. 44 of 1898) is to repeal the Imperial Act 3 William IV.. Cap. 15, so far as the latter Act gives playright in Natal to works first produced in Natal without the necessity of registration.

We do not think that the two systems would continue to exist side by side. provisions of the Natal Act seem to us to show that it is intended to supersede the Imperial Act in its application to Natal in respect of works first produced there.

(2) We think that such a supersession of the Imperial Act is within the powers conferred on the Legislature of Natal by Section 8 (4) of the Imperial Act 48 and 49 Vict., Cap. 33. Sub-section (3) of the same Section 8 provided for the modification by Order in Comcil of the Copyright Acts with reference to their application to any British Possession it, which an Aet or Ordinance had, before the passing of the Imperial Act 48 and 49 Viet.. Cap. 33. been passed respecting Copyright, and we feel no doubt that Sub-section (4) has the effect of enabling à Legislature of any British Possession to modify or supersede the Imperial Act in its application to such Possession in respects of works first produced there.
