MY LORD,
We were honoured with your Lordship's commands, signified in Mr. Bramston's
Royal Courts of Justice, August 24, 1894. letter of the 14th instant, stating, with reference to our Report of the 18th April last, respecting the power of extradition between British Protectorates and foreign territories, that he was directed by your Lordship to request us to consider the corre- spondence with the Foreign Office which had passed in reference to our Report, and that he was to ask us to inform your Lordship whether the Despatch of which the draft was enclosed might properly be sent to the High Commissioner.
The documents referred to in the draft Despatch were forwarded to us for reference. In obedience to your Lordship's commands, we have considered the matter and have the honour to
Report-
That, in our opinion, the Despatch of which the draft is enclosed may properly be sent to the High Commissioner.
As to the reference to the Cape of Good Hope Act of 1882, it should be considered whether that Act is not defective as to the safeguards provided by the Treaties, and the Extradition Act, 1870, with reference to political offenders, and other provisions for the protection of extradited persons.
