LAW OFFICERS to COLONIAL OFFICE.
Royal Courts of Justice, December 5, 1885. We were honoured with Mr. Wingfield's letter of the 4th ultimo, stating that he was directed to lay before us the correspondence and documents noted in the margin relative to the extradition from the Straits Settlements of fugitive offenders from the territory of the British North Borneo Company, and to request us to favour you with our opinion upon the questions raised in the Foreign Office letter of the 15th of August, viz.: whether the desired extradition could not be effected without a further Order in Council, and if not, whether it would not suffice to provide by the new Order in Council that the expression "a Foreign State" in the Straits Settle- ments Extradition Orders in Council, 1879 and 1883, should include the territories in North Borneo and adjacent islands, the government whereof was administered by the British North Borneo Company, and which were specified in Her Majesty's Royal Charter of Incorporation of the said Company, dated the 1st day of November 1881.
In compliance with the request contained in Mr. Wingfield's letter, we have the

That we are of opinion that, under the laws of the Straits Settlements, the surrender
of fugitive criminals to the British North Borneo Company can, if thought expedient,
be effected without a further Order in Council.
