MY LORD,

We are honoured with your Lordship's commands signified in Mr. Herbert's

Temple, July 1, 1872. letter of the 29th ultimo stating that he was directed by your Lordship to transmit to us a copy of a letter received in the Colonial Department from the Foreign Office, and of the telegram from Her Majesty's Minister at Washington in regard to the arrest and abduction of an American citizen by a Canadian official, and that he (Mr. Herbert) was to request us to favour your Lordship at our earliest convenience with our opinion as to the answer which should be returned to Sir E. Thornton.

In obedience to your Lordship's commands we have taken this matter into considera- tion, and have the honour to

That, under the circumstances, we think Sir E. Thornton ought not to demand the surrender of the American citizen.
