LAW OFFICERS to COLONIAL OFFICE.

MY LORD,

We were honoured with your Lordship's commands, signified in Mr. Herbert's

Temple, 19th February 1881. letter of the 14th February instant, stating that he was directed by your Lordship to acknowledge the receipt of the report dated the 8th instant respecting the Bill passed by the Legislature of New South Wales to provide for the control of the lands commonly known as the Church and School lands, and the appropriation of the income derived therefrom.

That Mr. Herbert was directed to state that since the date of the communication addressed to us from the Colonial Office on the 26th ultimo a further memorial prepared in this country on behalf of the Bishop of Sydney had been received from the legal adviser of his Lordship, of which a copy was transmitted therewith.

That your Lordship was disposed to think that the present case was not governed by the circumstance that Imperial legislation was obtained in respect of the clergy reserves in Canada; and the question of compensation as affecting the validity of the Bill under consideration had already been before us. however, thought it right to submit that memorial to us, and Mr. Herbert was to That your Lordship, request that we would be good enough to take the same into our consideration, and that we would advise your Lordship whether anything which was advanced therein affected the opinion expressed in our report of the 8th instant.

That we have considered the memorial submitted on behalf of the Bishop of Sydney, but there is nothing in it which affects the opinion expressed in our report of the 8th instant.
