LAW OFFICERS to COLONIAL OFFICE.
Temple, 20th September 1880. We were honoured with your Lordship's commands, signified in Mr. Bramston's letter of the 10th instant, stating that he was directed by your Lordship to request that we would favour you with our advice upon the following matter:---
By section 37 of 17 & 18 Viot. c. 117, the West Indian Encumbered Estates Act, it was provided that the purchase money on every sale should be paid, as the Commis- sioners might direct, either into the Bank of England or into the Commissariat chest of some Colony named by them.
That the Lords Commissioners of the Treasury had expressed their desire that the Commissariat chests in the Colonies should be no longer used for that purpose, and it was proposed to substitute the Colonial Treasury in each case; but that your Lordship desired to be informed whether, in our opinion, the powers conferred on the West Indian Encumbered Estates Commissioners by the 66th and 67th sections of the Act above referred to, were sufficient to enable them to vary the places of deposit specified in section 37.

That, in our opinion, the powers conferred on the West Indian Encumbered Estates Commissioners by the 66th and 67th sections of the Act referred to, are not sufficient to enable them to vary the places of deposit specified in section 37 so as to authorise the substitution of the Colonial Treasury for the Commissariat chest.
