My LORD,

WE were honoured with your Lordship's commands, signified in Mr. Lister's Prisoners at letter of the 27th October last, stating that he was directed by your Lordship to transmit to us the papers, as marked in the margin,* containing a petition by two from a prisoners in the Corradino prison at Malta for mitigation of the sentence passed upon church, &c.

Stealing them by the Consular Court in Egypt, and the Report of the acting Judge of that Court upon the case.

Condemned on three

That, from that Report it would appear that the two prisoners were jointly. indicted on three counts:-(1st) for breaking into a church and stealing, &c.; (2nd) for breaking out of a church and stealing, &c.; (3rd) receiving stolen goods. That the evidence related to one and the same transaction, yet a verdict was recorded of tion.

Guilty on three counts."

That Mr. Lister was to request that we would take those papers into our con- sideration, and favour your Lordship with our opinion whether, in view of the evidence, and in the absence of previous convictions against the prisoners, the sentence of ten years' penal servitude was too severe, and if so, what portion of it can properly be remitted.

That, in our opinion, the sentence in this case was too severe, and seven years may properly be remitted.
