LAW OFFICERS to COLONIAL OFFICE.
Temple, 19th January 1878. We were honoured with your Lordship's commands, signified in Mr. Malcolm's letter of the 5th October last, stating that he was directed by your Lordship to acknow- ledge the receipt of our report dated the 25th September 1877, respecting the validity of a proclamation issued by Sir Theophilus Shepstone for the establishment of a court of justice in the Transvaal territory.
That as your Lordship understood that in our opinion Her Majesty retained full power to legislate for the Transvaal territory by Order in Council, your Lordship conceived that Sir T. Shepstone's proclamation could be retrospectively validated by an Order in Council, and Mr. Malcolm was to enclose therewith a draft of such an Örder, on the terms and sufficiency of which your Lordship would be glad to be favoured with our opinion.

That in our opinion the proposed Order in Council is sufficient for the purpose of confirming and validating the proclamation of Sir Theophilus Shepstone.
