WITH reference to your letter of yesterday's date inquiring, by direction of Lord Carnarvon, whether James Morton, J.P. for Renfrewshire, is entitled to administer oaths, I have to state, for the information of his Lordship, that a Justice of Peace in Scotland is entitled to administer an oath on an affidavit or other extra-judicial proceeding. Unless there is any statutory rule in Canada requiring that a statement of the nature referred to in your letter should be taken before any special magistrate or officer, other than a Justice of Peace, I do not think there can be any doubt that the statement sworn before Mr. Morton, J.P., has been correctly attested.
