Temple, September 12, 1873.
I AM honoured with your Lordship's commands, signified in Mr. Herbert's letter of the 3rd instant, stating that he was directed by your Lordship to transmit to me the enclosed copy of a Despatch from the Governor of Gibraltar forwarding a memorial from Mr. Francisco Maria Montero and his wife, of San Roque in Spain, praying that the Governor might be instructed to approve a deed of sale of certain property now held by Mr. John Bernard.
That your Lordship desired to enclose a volume containing the Land Orders in Council referred to in the memorial, which would be found in pages mentioned in margin, and to request that I would take the papers into consideration and favour your Lordship with my opinion whether the deed of sale should be approved by the Governor.

That the Attorney General of Gibraltar appears to me to have placed the true construction upon the language of the Alien and Naturalization Acts, and I am of opinion that the deed of sale in question is not one which should be approved by the Governor of Gibraltar.
