We are honoured with your Lordship's commands, signified in Mr. Holland's

Temple, July 25, 1873. letter of the 24th instant, stating that, with reference to our report of the 26th July 1872, on the subject of the Promissory Act of New South Wales, he was directed by your Lordship to transmit to us a copy of a Despatch from the Governor of that Colony, enclosing a copy of a Bill which he had reserved for the signification of Her Majesty's pleasure, entitled "An Act to re-enact and confirm the Promissory Oaths Act, and to indemnify all persons in respect of the tendering or taking of certain oaths and the making of affirmations or declarations," together with a copy of the opinion of the Crown Officers of the Colony.

And that he (Mr. Holland) was to request us to take the papers into consideration and favour your Lordship with our opinion whether Her Majesty might be properly advised to assent to the Bill.

That we are of opinion that Her Majesty may be properly advised to assent to this Bill. Of course the provisions of section 36 of the Constitution Act 17 Vict. c. 41. must be complied with before such assent is given.

We are of opinion that the 9th section of the Promissory Oaths Act, 1870, was an alteration of a provision under the Constitution Act, 17 Vict. c. 41, concerning the Legislative Council, viz., the provision contained in sec. 33 of that Act, and conse- quently the Promissory Oaths Act, 1870, did require to be reserved for the signification of Her Majesty's pleasure.
