LAW OFFICERS to COLONIAL OFFICE.

MY LORD,

Lincoln's Inn, January 16, 1867. We are honoured with your Lordship's commands, signified in Sir Frederic Rogers' letter of the 29th of December 1866, stating that he was directed by your Lordship to request that we would favour your Lordship with a further opinion in relation to an Act passed by the Honduras Legislature To authorise the speedy "removal from the Colony of certain persons who may endanger the peace thereof,' which formed the subject of our Report of the 7th of December.*

Sir Frederic Rogers was also pleased to state that as it has at times been found very necessary, for the safety of the Colony, that the Lieutenant-Governor should be able to remove dangerous persons without legal proof of any criminal act, your Lordship was desirous of knowing whether the Legislature might not properly apply to the Colony, with certain qualifications, the provisions of the Imperial Act 11 Vict. c. 20., viz., by enacting.—

1. That the Lieutenant-Governor may order aliens to quit the Colony within a given

time.

2. That any alien not so quitting the Colony, or returning to it within a given time, shall be subject to adequate punishment by way of fine and imprisonment.

3. That any excuse given by an alien for not quitting the Colony when so ordered may be judged of by the Lieutenant-Governor in concert with his Executive Council.

In obedience to your Lordship's commands, we have taken this matter into con- sideration, and have the honour to

That we are of opinion that the Legislature may properly apply to the Colony of Honduras the provisions of the Imperial Act 11 Vict. c. 20. to the extent, and with the qualifications suggested in the letter of Sir F. Rogers, proper machinery and mode of procedure being adopted for the purpose of carrying the provisions of the Act so modified into effect.
