That we also think it is the better opinion that they can still suspend judges under the local Act 15 Vict., No. 10, s. 5, the power of suspension, for the causes therein mentioned, being not inconsistent with the tenure of the office during good behaviour, especially if the office is (as we consider it to be) held subject to the power of amotion for the like causes given by 22 Geo. III. c. 75.
3. That we think these questions might properly be referred to the Judicial Com- mittee of the Privy Council, as requested by the petition of the judges, under 3 & 4 Will. IV. c. 41. 8. 4.

Lincoln's Inn, January 13, 1866. We are honoured with your commands, signified in Sir Frederic Rogers' letter of the 2nd of January instant, stating that he was directed by you, Sir, to enclose copy of a letter from the Bishop of Barbados, who desires virtually to obtain a retiring
pension.
Sir Frederic Rogers was also pleased to enclose a copy of a paper printed for Parlia- ment showing the course which was adopted under similar circumstances in the case of the Bishop of Jamaica, viz., the appointment of a coadjutor bishop, remunerated by a portion of the bishop's salary, and Sir Frederic Rogers was pleased to request that we would take these papers into our consideration, together with the Acts bearing on the subject, viz., 6 Geo. 4. c. 88. and 5 Vict. c. 4, and favour you with our opinion, whether a like course could properly be resorted to in the present case.
Sir Frederic Rogers was also desired by you, Sir, to add that the perpetuity of the Parliamentary grant for the support of the West Indian bishoprics must be considered as doubtful, and that you would not therefore be prepared to give to the coadjutor bishop an interest in the salary of the Bishop of Barbados, extending beyond the life of the latter.
In obedience to your commands, we have taken this matter into consideration, and have the honour to

That we think the precedent of Bishop Courtenay may be safely followed, care being taken that the coadjutor appointed be apprised that his salary can only be guaranteed during the life of the bishop, and by the bishop's consent.
We do not see our way to recommending any direct pension to the bishop apart from this arrangement.
