be, not to seize or restore the prize, but simply to require the immediate departure both of the captured and of the capturing vessel. It is only when the capturing vessel has been fitted out or manned in violation of our own laws that the right or obligation of taking possession of the prize for the purpose of making restitution supersedes the general obligation to respect the public commission and the actual possession of the capturing vessel.

MY LORD DUKE,
Lincoln's Inn, March 3, 1864. We are honoured with your Grace's commands, signified in Sir Frederic Rogers' letter of the 23rd February ultimo, stating that he was directed by your Grace to submit for our consideration the enclosed draft of a Royal Charter, which, in accordance with the suggestion made in our letter of the 29th January,* had been pre- pared with the view of constituting the Lieutenant-Governor of Natal and the members of the Executive Council for the time being a corporation for the purposes described in the charter, and to request that we would inform your Grace whether a charter of incorporation framed in these terms would be proper and effectual for its purpose, and if not what alterations should be made in it.
In obedience to your Grace's commands, we have taken this matter into considera- tion, and have the honour to
