Doctors' Commons, March 9, 1860. We were honoured with your Grace's commands, signified in Mr. Merivale's letter of the 31st of January last, in which he stated that he was directed by your Grace to transmit to us a copy of a Despatch from the Governor of the Bahamas, having reference to a case in which a bill of complaint which came before him in his capacity of ex-officio Chancellor of the Colony from certain resident agents of French and American Insurance Offices, praying for an injunction to restrain the captain and agent of a wrecked cotton vessel, the "Redwood," from making any adjustment of salvage in reference to her cargo and specie until further orders were given.

Mr. Merivale was also pleased to request that we would take the circumstances stated in the Despatch submitted to us into our consideration, and that we would favour your Grace with our opinion on the following question: Whether the Governor of the Bahamas would be justified in confirming injunctions for restraining such payments when the complainants cannot positively declare that they are the agents of the com- panies interested, but only state their belief that they are so ?

That the Governor of the Bahamas would not be justified in confirming or granting injunctions for restraining the payment of salvage, where, as in the case described of the cotton ship "Redwood," the complainants cannot positively declare that the principals for whom they are agents are interested in the ship or cargo, but only state their belief that they are so. It would be a very illegal thing if an interim injunction were granted in order to give time to persons to discover whether they have or have not such an interest as, if proved or admitted, might entitle them to interfere in pending proceedings between others.
