IV. If the Church of England is to take root and flourish in the Australian Colonies, and to maintain her own against the vigorous and thriving Churches around her, she must, like them, be left entirely free from all secular legal impediments, and allowed to work out her own destiny. When thrown entirely on her own resources, and unfettered by any connexion with the State, she will and must, from her own interest, vitality, and elasticity, rise superior to all her difficulties; and will succeed in doing what other Churches have done before her-establish herself firmly in the affections of all her members, and become a prosperous and steadily advancing Church. But if she is to be restricted in her operations in any way by the British Legislature, and thus loses her freedom, she will continue to retrogade, until instead of taking the lead, and gradually absorbing into her communion, a large proportion of the non. conforming population, which is her appointed task if wisely governed, she will sink into a small and insignificant sect; she will "gie of her dignity" and her own shortsighted policy.

I HAVE the honour to acknowledge the receipt of your Despatch, No. 31*, of the 24th of November, forwarding a petition to the House of Lords signed by the Bishop of Melbourne as President and on behalf of the Assembly of the licensed clergy and laity of the United Church of England and Ireland in Victoria, praying that no logislation be sanctioned which would have the effect of throwing doubts upon the substantial unity of the Church in Victoria and the Church in the Mother-Country as heretofore established.

You likewise enclose a letter addressed to me by his Lordship on the subject of the memorial.

I request that you will inform the Bishop of Melbourne I shall willingly present to the House of Lords the petition enclosed in your despatch.

I Have been apprised by the Archbishop of Canterbury that it is desired to fill up two dioceses or reputed dioceses which are now vacant in New Zealand.

As, however, in the recent case of the Bishop of Natal the Judicial Committee of Privy Council have declared that Her Majesty has not authority to create dioceses in Colonies possessing Representative Institutions, I have been unable to recommend that the usual Letters Patent should be issued.

I have been advised, however, by the Law Officers of the Crown that a mandate may properly be issued, under the Royal sign manual and signet, authorizing the Archbishop to proceed to the consecration of two persons who will exercise episcopal functions in New Zealand, but leaving the ecclesiastical authorities of that Colony to determine as they can with the clergymen so consecrated the geographical limits to which their duties are to be confined. Such a warrant has accordingly been issued in favour of Dr. Andrew Burn Suter and Dr. Henry Lascelles Jenner, who I understand are to be consecrated by the Archbishop in Canterbury Cathedral on the 24 inst.
